Default Tranny fluid level

I keep reading that the numbers of quarts to put in are 5 but I removed the tranny afrom the engine emptied the lines out, removed the radiatos and possibly leaked out more tranny fluid from there. I recently installed my tranny back on and refilled with 5 quarts. I ran the car and as soon as I stopped the engine I was getting a sucking noise from the transmission. It then started pushing fuid out through the dipstick tube. i was told that maybed the filter element was loose. I took the filter out and replaced it.

Two questions, 1. Can the sucking noise be from something else? 2. How much oil should I really put?
