Default is this axle ok to install?

I pulled my 12 bolt apart to install a spool and gears and found this....

its a moser axle. it looks like the splines twisted. it still slides in and fits fine. not sure how but it does. I am worried if i put it back in the axle will snap eventually right there. anyone see this happen before? i thought 12 bolts were strong. pretty shitty my $2,400 rearend broke an eaton posi and looks like some bent axles. not happy with the quality at all. i should have went with strange.

^^^ that. You can give strange axles a try or upgrade spline count and get another spool.

Just wondering, how many splines is that and what kind of 60s have you been pulling with it?

Moser just told me on the phone, they usually wont warranty something like this but he will see what they can do. seems that if it snapped in half they would warranty it but this isnt broken enough or something. i'm waiting for Speed Inc to open so i can get the original po# for the order placed with moser at the time i bought it.

this is what the moser webpage says:

REPLACEMENT POLICY
in addition, Moser Engineering, Inc. will replace their 33, 35, & 40 spline axles for a period of ten (10) years after the original date of purchase if broken at the splined end due to excessive horsepower. However, 33 spline axles that were broken due to excessive horsepower will be replaced at the sole option of Moser Engineering

so basically he could just say no for any reason and stick me with payin for new axles again. I got a feeling this wont turnout very well.

update: moser told me by the picture it looks like they will just go ahead and warranty it but the decision needs to be made when my axles get shipped back and they see them in person. so i shipped them out today. he said we can work something out to where i get to upgrade to a 35 spline if all goes well. i'm keeping my fingers crossed.

Moser decided that I would break the 33's again with my power so they upgraded me to 35 spline and shipped them to me for free. So all I had to buy was a 35 spline spool for $190.

Matt @ Moser Engineering was awsome. definetly great customer service. he went above and beyond to make sure I was happy.
