Any advice on how to appeal my license?

Default Any advice on how to appeal my license?

I thought I fought the good fight and won, but apparently not.

I recieved a notice in the mail after my hearing yesterday that said my license was suspended for 60 days. It says i can appeal the administrative decision,
"I MUST SEND BY CERTIFIED MAIL A COPY OF THE COURT CERTIFIED PETITION TO THE DEPARTMEN AND TO TEH STATE OFFICE OF ADMINISTRATIVE HEARING OFFICE THAT IS RESPONSIBLE FOR THE DECISION."

also it says the decision may be appealed to pursuant to tex transp. code an 522.105 (d)
The reason im appealing is because the probable cause to pull me over is wrong, it says i was going 110mph in a 60!!!! which was the cause to pull me over, when in fact my buddy was the one going that speed limit and even got the ticket. The officer had no probable cause to pull me over. for a MINOR dui (.050)

Anyone on here know how to appeal something like this, as for right now i am at a total loss. and have 30 days to try to make my appeal.

i don't think i would state in the appeal that you know the guy that was driving 110, thats just good enough reason for them to assume you were going 110 too.

anyways....call a lawyer

you need a lawyer in a bad way. You are making too many assumptions about probable cause. Forget being a jailhouse lawyer and pay for good legal counsel. Here is a hint. Lawyers and judges hate people who come in to practice law defending themsleves. Don't ask me why, it just seems to annoy them to no end.

I know because I tried it. I made the same arguments my lawyer did. They listened to him. They ignored me.


Get a lawyer...

get a lawyer...and I don't think theres anything Minor about a DUI just ask MADD

Contacted a lawyer, said i needed to contact denton county court house and find the paper work to file the appeal.

also said $500 for his services plus 300 more for paperwork fees... i think ill just catch some rides for 60 days and drive safely

good advice.. got a lawyer, $750 and they are cleaning my record as well and getting me my license back

Anytime your in the "system" you need a good lawyer....
