Default Worn Motive 4.10 Pinion Gear?

Pictures attached. I've had a horrible whine pretty much from the start with these gears. The teeth on the pinion appear to be very thin. I'm thinking this could be the problem? Just a worn pinion possibly from a bad install?
Tell me what you think.

Anyone? Let me know if the pictures aren't enough. I took them with my cell phone. Also it's the thin teeth on the pinion that maybe causing the slop.

Yes it's a worn pinion gear. It was shim'd improperly by the installer. Answers the horrible whine it produced.
