Western Members - Modified Exhaust Ticket. (27151) .. How do I beat it?

Got pulled over this morning in Studio City at 3:15am while giving a co worker a ride. Had no idea why. Cop rode my ass for half a block before pulling me over. Gave up my info. Cop said that he pulled me over because I had something hanging from my rear view mirror (iPod headset draped over mirror). Realizing it's not a huge deal, he goes back to his cruiser for almost 20 minutes. Comes back and says "sign here. Btw this ticket is for a modified exhaust" ... **head shaking** My foot was off the throttle the whole time he was behind me. Not even kidding! I practically glided her at 15 mph in a 35 because my co worker was looking for a stupid street sign. ... W.T.F.!!

Decided not to argue it. Just signed and went on my merry.

Any advice or do I just pay it and call it a day? I hear that the fine is something like $200. I'd rather not pay that if I can help it.

I read somewhere online that if you get a ticket for an exhaust and the police officer DOESN'T ask you for certification of Decibel level, or even ASKs what db your system is, then he's citing your vehicle wrongly! ... Has anyone else heard this before? ... If its true, I figure I'd just do a trial by declaration (trial by mail) and basically state that provision 'B' of the 27151 vehicle code wasn't violated and aim for a fee refund from the court.

Not true. If it's a referee ticket/non-correctable violation (check the back) then you would NEED to take it to a referee and it couldn't be signed off at a CHP office. Or pay the fine. The fine can be anywhere from $400 to $1600 depending on the courthouse.

Its marked as 'YES' under Correctable Violation.

if its a ref its $1000+ in most cases to just pay and be done.

i got like ten of them. in mn they dont care really. i just have a friend at a shop do a db reading and bring that into court.

Last year, I got 4 modified exhaust tickets. I just paid $194 for each ticket at West Covina Courthouse. I'm guessing it shouldn't be a lot at other courts.

I paid $285 for my corrected REF ticket but I spent a shit load making the car legal to pass REF smog.

If you correct the violation, I believe it will be less than $200. I paid a $25 dismissal fee for window tint.

Mine was $108 for the dB certification paperwork... Plus the cost of a stock exhaust system... And the cost of having the stock exhaust system welded at the over-axle section... And the cost of gas to go to a referee 3-4 times (2 different ones. one time one didn't show up, one time it failed, and another time it was for an alternate measurement to make sure the test was done right). Plus the court fees to pay off the ticket itself.

It's not a ref ticket. You're not even allowed to drive your car if it gets reffed. Some you can just pay, others you need to take to CHP to get signed off. I've never had to go to the chp for any modified exhaust tickets and I've had more then I can count. Cop can't prove when you get pulled over how loud your car is anymore then you can prove it's not.

Now if a cop looks under your car and doesn't see cats, then that's a different story. Last time I got reffed I just never even went to court. Turned FTA and I ended up paying like 800. It's all about the money. If you let anything ride long enough in this state you can just pay it off. Was easier then paying to have my fully built car put back to stock and going through the whole process.

Ref tickets are easy if you own your car , transfer your title to good friend , go to court with proof of transfer , tell the judge you sold the car as you could not afford the repair cost , case dismissed
Few months later transfer the car back into your name

That isn't supposed to work. You get the ticket, thus you are responsible for paying off the ticket. The ticket stays with you, not the car. At least, that's how I understand it. Have you ever done that? Do you personally know anybody that has done that?

I'm pretty sure the ref stays with the car, meaning next time the plate is ran even with a new owner it will show up even though the former owner is responsible to fix it because either way on owner change the car has to be smogged. It's a catch 22

It's like this, when I got my ref ticket he said the car couldn't be driven and if it was it could be towed. So even if my friend drove the car and I got the ticket, he would still know the car was red flagged.

haven't done it personally , but does work.

the police officer needs a warrant to look under you hood, unless you don't know your rights and pop the hood because he asked. the only reason you would have to open your hood or allow a search is if you are on paper and or have search and seizure limitations (probation/parol) then you do what the Nazi's say.

I have heard both sides but I think it was better to err on the side of caution. He could have easily got a warrant, then had me open the hood, write the ticket and then impound the car.

Got the exhaust fix-it ticket, I got ARH longtubes and aftermarket cats and had the GMMG catback exhaust, I just said fuck this and found someone who sold me the SLP dual-dual muffler for 50 bucks and replaced the muffler.

I introduced myself to a L.A. county sheriff, we used to talk everytime I saw him at the local Starbucks, anyway I told the guy that I had a fixit ticket for modified exhaust AND tinted windows, I told the sheriff that I replaced the muffler and now it's factory.

He actually didn't care, he didn't even take a look at the car, but he had this special rubber stamp that is used for fixit tickets, he stamped my ticket, filled out the stamp portion and that was that, paid 50 bucks court fees and it was over.

this was last year, around June or July of 2011.

I think he just figured that I was being honest, and since I'm an old man he figured I wasn't lying?

Anyway, that is a vague ticket, can go many ways but if the officer did NOT state too loud and just said modified exhaust I'm pretty sure you can get an officer to write it off HOWEVER they need to have that stamp handy to stamp the back of your ticket, that special stamp is what makes it legal I guess.

This is the main reason why us Thirdgenners on the SoCal TGO board Stay away from Flowmasters and keeping the cats on and also keeping all the smog equiptment on. Don't want the hassel. Those SLP Loud Mouths will keep you in trouble especially without cats.
