Default Internet Fraud Charges 4/1/05 on Jantzer ( renamed )

Well Folks I know this is stickied above but I am getting a list of people that have paid for product and not received, or got product and sent back the cores to not get the refunds.

I have sent countless emails to several different accounts. PM is full here. Tired of being nice and waiting. Pretty much all the same story I have been reading up here.

I have group legal through my work and will be calling to get full info on everything that needs to be done since he does not live in NC. Since for me its less then $500 most likely they will say to goto small claims, but again he does not live in NC so I am not sure again how to do this. Possibly a class action lawsuit so we all can combine and get paid. I will check into that also. (need more then just me for this extreme)

Also since this was done through the mail, I am checking into Mail Fraud Charges. I luckily paid through PAYPAL using my BOA credit card, and will call them to see about disputing the charges. One BAD issue is that by being strung along for so long it passed PAYPALs dispute date limits.

Please email me at dbaxter@baxtersystems.us if you would like to join the list for a mail fraud investigation.

I will keep a list of the names and will email you back once I find out exactly what .the FBI, or local Law requires to move on this. Most likely the normal, name, address, phone, product purchased, amount owed.

Please do not send me ANY credit card or bank info, let the law have that when they ask.

SORRY SCOTT. You asked for it, we all tried to be nice.

Mods I am not sure if this can be link into the detail and appearance, and gp forums since many of the people are waiting there. If so could you please??

( this was also emailed to him so he can't say he did not get it. )

Has any of the moderators tried to contact him to find out the status of our parts??? I'm going on two months now without my throttle body, which is crap.
If not, can you inquire to get our LS1's back on the road.

Can you believe it I FINALLY GOT a RESPONSE!!!!

Very IMPORTANT for you guys, PAYPAL dispute and Credit Card Disputes are only 60 days. So since I let this go on for well over 4 months for just my stuff I AM SCREWED.

BTW: as stated in the email back to him, yes I did call the fbi and yes they did ask me to file a complaint up on the fbi internet fraud web page.

http://www.ifccfbi.gov/index.asp click the button [ file a complaint ]

This page pretty much sums it up accurately.

http://www.ifccfbi.gov/requirements/nondelivery.asp

Other Non-delivery of Goods/Services
(not from an auction)

Personal Information

Whether you are filing the complaint on behalf of a business, business name (if applicable), full name (first and last)*, date of birth*, address (street, city and ZIP code)*, telephone number*, e-mail address*, gender, your local law enforcement agency, the easiest or most convenient way to contact you.
Whether or not you live within city limits.
The type of fraud or other crime that you wish to report.
Whether you have pertinent documents in paper form.
Subject Information

Business name (if applicable), web-site (if applicable), full name, address, telephone number, e-mail address, gender.
Information concerning your contact with the subject

Total monetary loss, method of contact(s), date of contact(s), monetary loss resulting from each contact, a description of your payment transaction(s) with the subject, a narrative description of the contact(s), general narrative description of the fraud, information on witnesses, information on other victims, identification of law enforcement or government agencies you have contacted concerning this matter, and any other information you believe to be pertinent.

My email server was acting up and I had to do some maintenance on it, sorry for any NDR's.

Email thread

Well I will be damned, you finally responded. Why did it take threatening legal action or getting the FBI involved finally get you to answer?

Why would you send to any other address then the one I used to contact you in this email?

You never put any time limits on core charge refunds ANYWHERE on ANY POSTS or on your WEB PAGES.

Additionally, if there was a time limit why did you not state this when I emailed you about returning them for the CORE REFUND in December, I would have put the damn things up for sale instead of paying to ship them to you. YOU STATED NOTHING when I said I was sending them to you. NOTHING, including stating several times that you were PAYPALing me the core refunds.

Dude, cost is not a problem. I have more then enough money to hire a lawyer, and take you to court over this.

Just to make your day since you were such an *** about this, I just called the FBI and explained to them exactly what is occurring and that even ls1tech removed you for non-payment and non-shipping of parts. They asked me to post file a claim up on their internet fraud website - http://www.ifccfbi.gov/index.asp and to contact my local authorities. Doing this to one person probably would not have got on their radar, but as many people that have posted you OWE parts or money to and being removed from the site did, your about to see what happens when the FBI investigates you for fraud.

I would suggest getting a loan real quick and start paying people back, or returning parts real quick.

Send me my money or the parts back.

It is sad it had to come to this, I was a huge advocate of your work, and recommended you to everyone I know. You can be sure that had ended.

Derrick

I'm assuming you won't get this email either, if not oh well. Not much I
can do about it.

I have every intention to get your core charges back to you. I'm starting a
new job monday and will have the financial resources to do so soon.
Probably just before the end of april. If things change and $ becomes
available, I will refund the $ sooner. That's the best I can do.

You can threaten all you want, but I know as well as you it's a moot point.
It would cost you more to try to get a lawyer involved and they would be
hard pressed to get $ that isn't there and there certainly is no fraud case
because there was no intention on my part to defraud and as I've always
said, I do intend to refund the money when possible.

Also one more thing, you can't turn in cores 6 months after you received the
TB. It doesn't work that way. I will check on the date the first TB was
delivered to you and if it's been a reasonable time I will refund the $. If
not, I will send the TB/MAF back to you and you can do with it what you
want. The only way for me to manage my inventory is to require the core
back within a reasonable time (usually 2 months) and so people don't find a
cheap core somewhere and abuse the system to make a profit.

Scott

UPDATE:

I have 3 TB's and a set of brake calipers to finish up and I'm square with everybody as far as product is concerned. I have a few core charges to get back to people. I have NOT taken any new orders in a couple weeks. Obviously without income and getting core charges back to people as best I can, money is tight. I'm starting a new job on monday and will be able to catch up on core charges by mid-late april, if not before. I'm working all weekend on the remaining parts and will be working nights after work to get them done. So I will be completely caught up next week. If you have not received your TB yet, you will soon.

I never intended for parts to take this long or slow core refunds. I guess I got in over my head a little. But I would never rip anybody off or defraud anyone, period!

As for Derrick, the one core charge you want refunded is from your order placed 3/14/2004, that's over a year ago. You can't just wait 6-12 months or whatever down the road and expect me to refund the core. I have to purchase new cores to keep my inventory up and the only way to manage it is to require cores back in a month or two, which is more than enough time to get the new TB installed. But like I mentioned via email, I will work with you on it. Apparently that isn't good enough.

As a business, I could fold up and not follow through with any debts. But that's not me. I'm a man and will follow through.

Well folks I got another email and he is at least sending back my parts by the end of the month.

He did say that he would make sure to make good with everyone.

I really did not want to go this route but when I, and everyone else was getting ZERO responses something drastic had to be done.

Still no core charge returned here, core was shipped in August 2004 and numerous PM's sent and posts made on here about it. Do we each really need to file a claim with the FBI to get this damn core charge back? Still waiting Scott.

Don't PM Scott, send him a direct email. Are you listed above with the people he has listed he owes?

Good to see everything is coming together. I was really looking forward to sending you a TB to do the full work on. I'd still love to have one done, but seems as if you will be a little busy for a while.
