It depends on your local county. Here in PA, our legislation state specifically that "exhaust must be extended to the furthest extent of the body, be it the rear, side, etc.", or something to that nature. I know some of the mid-west states are a little more lax in this area.
The actual inspection / emission legislation should be public information for your area, and a quick search through your local DMV's website should bring it up. Best bet, to be sure, is to read through your local jurisdiction's info...

okay thanks guys - i'm in the chicagoland area, and i've heard that i'd be okay - but i don't want to spend the money on an exhuast set up that i'd have to just rip right back out when i take it for emissions.

You live in IL. You are in Cook County I assume? We do not have visual inspections here, only OBD scan test for '96+ cars, and a gas cap test.
You would only need to get a visual inspection if you had failed multiple tests, met all criteria, and were trying to apply for a waiver.
Having said that, I've personally never gone through the test without tail pipes though. But passing with headers/ORY and pipes out the back was no problem. And they never gave the car a visual.
