Canadian Members - 401 construction = car destruction

Driving through T.O. towards Hamilton on Monday afternoon, and through the construction zone around 401/Islington area, I hit a small pile of cement right in the middle of the highway, where they're doing road work, resurfacing, etc. Check out the pictures of the damage it did to the exhaust on my car!! :( This is on my '02 Camaro Z28 ... the whole exhaust - headers, cat's, y-pipe and cat-back - were all brand new this spring, and worth close to ~$2000. At least half of it is trashed, pipes crushed inward, etc.

Does anyone know what type of legal "responsibility" the province has to maintain roads in a clear, SAFE condition?? :confused: Or is this simply a matter of going through insurance?? I have no idea what to do. All I know is I'm really p'd off about it, and I normally don't get mad at other people very often :(.

You can try contacting the gov't and they can take a look into it.

I was with a friend once when he nailed a large pothole on Islington and messed up some of his front suspension components along with a bent rim. He took pictures of everything and sent a letter into the government with what had occured and they re-imbursed him for the repair charges.

Well, I just called the MTO, and you're right, they do have a "claims" department for damage to vehicles due to road conditions, construction, etc. (416-314-3445 ;)). Basically I just have to submit to them a letter describing the incident, where/when, etc., extent of the damage, estimate of cost to repair, etc. Fortunately, I had a friend with me who can act as a witness to the incident, so "hopefully" I can get this resolved???? I really don't think I should have to pay out-of-pocket for their mess :rolleyes:. We'll see .....

That had to sound wonderful going under the car... that's rough man, I hope they give you some money toward it. You may want to call your insurance company(if you have full coverage) get the money through them, and let them do the paperwork to get the money out of the providence. They usually have more money for lawyers for that kind of stuff.

My buddy nailed a huge pot hole and punched a hole in the oil pan of his 10-sec barracuda..he went to the city, they did nothing. Looks like you'll be fine though....

yeah i went over someones drill bit in a construction area and almost lost control of the car when my tire blew out! Luckily in Quebec, they passed a law saying that they aren't responsible for the roads or whats on them

Not until I get this letter sent out to them, with attached photos, copies of receipts for all the parts, etc. ;) I stopped by yesterday and had Darren write me up a receipt for doing the cats, but now I'm wondering if I should probably get an official quote to fix the whole thing (including labour costs) because right now all I can prove is the cost of parts? :rolleyes: I guess I'll send them what I've got for now, and see where that goes :cool:.

Get the entire quote to fix the whole job. Darren will help you out and if you need the hoist for more pics let us know. I am hoping you can recover these costs, cause that really sucks.

when i lived in shwa, they decided to paint road lines and not put up any signage.

yellow road paint looked really good up both sides of my white truck. city didnt do anything! i had the paint fixed at classic autobody what a shitty job they did!

Well, just for a quick update, I sent off my claim to the MTO, and I got a call back within a couple days from an adjuster who is looking into my claim. He said it will take MINIMUM a couple weeks to conduct his preliminary investigation and get back to me ... so it's not a "yes" or a "no" at this point ... just sit back and wait.

jUst make sure it doesnt go to or through your insurance or your car will get pulled off the road. Headers are not stock and they will claim your car has been modded for racing.

Man... I had my car damaged from those lame potholes on lawrence avenue, well pretty much ANYWHERE in toronto.. and yea.. 401 sucks big time so does 427... so many irregularities, holes, potholes, cracks, patches, inequalities, just crap utter crap... definetely gets me pissed and worked up :(

I wouldn't mind if we organized some kind of petition or something... all that tax money yanking, ticket giving and the crappy 'racing' and 'modified for racing' garbage lately and we get crappy roads :confused: The suck...

Still haven't heard anything since I spoke to the guy on July 24th, although he said it could be 2-3 weeks at least :rolleyes:. My car has been off the road for an entire month now, right in the middle of summer ..... this is killing me!! :( But I've been too busy (read: broke ;)) working on my house this summer to do anything about it, damnit!!! Ugh, I might have to break-down and fix this thing myself?!
