Default Serious tech help needed. Pls

Ok, 96 TA w/ retro 98 LS1, M6.
Just had the tranny rebuilt. An aftermarket kit was given to the guy with steel components, new gears bearings, etc. He said the 3/4 fork wouldn't work so he just decided to put a stock fork in.
OK, So we got it back in and put 2 miles on it, It stuck in 2nd.
So, we take it back to him and tries to say it had no fluid. Well, when he opened it, out it came, all Dex 3, So somehow it fried a bearing, He ended up charging another $200+. He says it's right...uhh,OK.
We get it all back in, do a test drive, 6 miles good to go.

Here's the kicker...at 21 miles it stuck in 2nd again. Then he (my friends car) jumped on cause he was soooo pissed. All of a sudden it shifted out to 3rd. He went back to 2nd and it stuck again.
If anyone has any ideas (other than beating the living *(**^^$$@$^)*(&%#%#^ out if this guy, Please help us out
