He advertised a TSP lid for sale on here so I contacted him and offered to buy it. He accepted. This was on Wednesday the 17th. On the Thursday 18th, I email him with the tracking number (www.airborne.com #59375592172) informing him that I had overnighted a check to him. He informs me that he will send it out first thing in the morning and I would have a tracking number on Saturday the 20th but no later than Monday the 22nd. Fair enough.

On Monday the 22nd I see the check clear my bank (03/22/04 Check #1199 95.00 (taken directly from my online statement)). My bank normally runs weekends a day behind so the check was most likely cashed that Friday and hit my bank on Saturday although it posted to record on Monday.

Although it was abundantly clear that I was sending a check (it says so in my email to him), I gave him the benefit of the doubt that he was being careful. Not a problem however I know for a fact that the check cleared no later than Monday the 22nd. So today I email him asking for a status. I was rather surprised by the response I got. I sent two messages. The first listed below details the entire thread while the latter one is truncated to my second email and his response...

I find it interesting that I am one major pain in the *** considering my last email to him was on the 18th providing him with tracking information for his payment and my next email was on the 25th asking for a status. Doesn't seem like a pain to me. Now for the most amusing of the messages...

Here you can see the major problem with this picture. I don't feel it was too much to ask that he overnight a lid that was supposed to ship to me 7 days ago. Don't forget, he ships USPS 2nd day (so he said in his email).

To that, I issued this response...

THAT WAS LAST WEEK...

I will not accept any bullshit about you only checking
the bank on Fridays. You have internet access and I've
spent enough time in NYC to know that every bank up
there has online banking. You have no excuse for not
living up to the terms of the deal considering you set
them.

I will expect a tracking number within 24 hours
delivering either my money or my lid.

Oh and by the way, I am a Sr Data Security Analyst.
It's my job to investigate and assist in prosecuting
fraud. If you do not give me the information I demand
within the timeline I have set, I will report the
transaction to my bank, your local district attorney,
and the FBI.

I was polite in my emails and was asking only for an
update. You had no problem putting my check in your
account so fast that it cleared MY bank on Monday and
you have the nerve to respond to me like this...

You have 24 hours, no more.

I've saved a copy of the thread incase he deletes it.

Sounds like he ran the lid on eBay and scammed another user. You will also note in the thread that he accepts money orders and checks but no paypal. Interesting to me in retrospect...

He has one chance and only one chance. He says he does his banking on Fridays so he shouldn't have a problem writing a check and sending it along. Had he not replied in the manner he did, I would have been inclined to give him a little more time but it's obvious to me that he has no intentions of completing the deal and I'm not going to wait for a month of excuses before taking action. The sooner you respond, the better your case is and it's always easier to stop an investigation than it is to start one late. If he delivers tracking number tomorrow (and a UPS "billing receipt number" will not suffice), I will post the details and follow up should I actually receive anything.

Should make for some interesting reading anyway....

Bryan, you are not the first person Unstable Vic has dicked over. Looks like he chanced his user name after the last time someone complained about him here. I've read complaints about him on LS1.com also. Sorry he did it to you too.

I appreciate the support fellas. I'm not too worried about it right now although I'm sorry to hear he has wrapped up others as well.

Regardless of who is who, I now have a second address, telephone number (cleverly hidden under his wifes/sisters name), and some other information about Mr. Idapse. I've contacted several other people with interactions with him and will obtain their statements and information. This information will be turned over to the Bronx DA's office and the IFCC tomorrow.

Here is an update for everyone. He sent me several rather hot messages in response to my "excuse me" email. The last one he offers that he might have me confused with someone else. Starting at the bottom, here is what transpired. If the deal does not work out, I'll post the rest of the emails and my reponses. If it does, I will clear his name with the IFCC and not pursue any other action with the Bronx DA's office.

It's not a problem and don't worry about the
extra 5 bucks. It was my choice to overnight the
payment and I take responsibility for that. To be
honest, I would much rather have the lid in good
condition than a refund however either will satisfy my
requirements.

I accept your apologies and I appreciate your
offers. Once everything clears up, I will ensure that
fact was passed on to the required parties. Again

ok jerkoffs, his tracking # is 03031290000080272900 USPS Priority mail. It was mailed March 19th, and delivered and accepted on March22nd at 9:40am.GO CHECK. I also furnished Bryan with my cell # and asked him to call me several times AFTER he was furnished with the tracking info, but he never called. The USPS website has the tracking just like ups. I prefer using the post office even though it is a bit more costly because everyone gets there parts quicker, 2-3 days gauranteed by uncle sam! I never beat anyone. Bryan, come out and admit YOU made the mistake, be a man and fess up, all will be forgiven. racrx

Also, for whoever cares, I changed my internet provider to high speed dsl, and hense the name change. racrx just sounds cool...lol, and I was a big speed racer fan back in the days, oh ****, there I go again showing my age...lol.

I spoke with Victor on the phone just now. He seemed very eager to get this worked out. We both agree that I will check with my mail room and the local Post Office on Monday to see if the lid is there. He was quite helpful and apologized for the mixup. He understood my point of view after reading his initial responses and agreed he might have thought the same thing. With the obvious delivery of a package, it appears Victor made good on his original word and this can be discounted as a miscommunication.

With a little good fortune, Moday morning I will be on the board changing "racrx is a potential scammer" to "racrx is a good seller".

Victor - thank you for the conversation this evening and I will let you know what I find on Monday. Thanks again.
