Need a Houston Lawyer - Divirce specialist

Default Need a Houston Lawyer - Divirce specialist

My girl friend was divorced, and it has been finalized in court for 90 days +. She paid this attorney (referred by a co-worker) for $750...sounds like a hell of a deal? Sure it does, considering it was un-contested, the ex-husband keeps the house, all debts, investments, gain and losses were each person's responsibility going forward. Easy, but not so fast.

First of all, the house was never taken out of her name. The ex was delinquent on mortgage payments. Her credit score took one hell of a hit. She can not borrow money to buy a care, she can not take out student loans for nursing school because of her credit score, and b/c a $150K note is attached to her name. it gets worse...

She finally gives up on her dead beat ex on trying to get him to make arrangements to have the house stuff taken care of (keep in mind he did not pay any attorney fees, not showed up top court)...and the lawyer, is all like "oh yeah now I remember you...Yeah, I totally forgot to submit the Special Warranty Deed to court." HE then calls her back and said I cant do this unless you pay me another $950. She then questions him, and why this is so, and he replies with "Im not taking 2 effing hours out of my day to drive down to Galveston County...do it yourself its in the mail."

She is now pissed, confused, and desperate to get this rectified. She is willing to put the house up for sale if that is what it takes to get this out of her name.

I suggested filing a complaint with the Texas State Bar, then find another lawyer that will take the case based on a percentage of the outcome 50/50 (In know that is high), sue the ex for "Breach of Contract, Contempt of Court, attorney's Fees, and personal damages due to credit penalties.

IS there anyone here in Houston (Harris/Galveston County) that is willing to help this girl? She works as a medical assistant by the hour, is up to her *** in debt, and has been shafted too many times.

Any lawyer with some time and vision can easily take this case (on a percentage basis) and make some quick easy money. Please PM me on here with any leads or references. Thank you so much in advance. She has all necessary documents a lawyer would need to proceed with this matter.

File the papers the lawyer is sending. Have her call the mortgage company and see if she can pay the interest or refinance the house to buy some time. It doesnt matter what the divorce says, she is responsible for mortgage until it is taken out of her name. Move into the house. Maybe rent it. There is ways but it all takes time. $750 is a damn cheap divorce. Maybe that is why the lawyer didn't take 2 effing hours out of his busy day! Good luck!!!

msGTO is correct. In a Texas divorce, you cannot remove either party from the deed or note without selling or refinancing the property.

Yeah, I understand she is leagally responsible, but there was an agreement, a contract signed and approved in a Harris County Court. She has a new attorney, and is suing the ex-spouse for "Breach of COntract" and "Contempt". He had is chance to get off scott free with everything handed and forfeited. She is now pursuing half of all assetts aquiered between the two of them during the time of legal union.

This means, half the house, house his truck, half his 4wheeler, half his 401K, etc...

As far as the ****-bag lawyer who told her pretty much "to **** herslef" after realizing that he never even issued the Specail Warranty Deed, b/c it was "out of his way". He will be filed on with the Texas State Bar, adn suing for the $750 + new attorney's fees.

First red flag $750.00 in attorneys fees..Sorry to say. She should have gotten half of everything in the first place. But I understand how someone would want to just be relieved to get out of a bad situation. But also half of her assets are his too. It sounds messy.

give us the name of the attorney and we can also bury him/her on the bathroom wall of america "the internet". Sites like superpages, citysearch, google, yahoo, yellowpages.com etc all allow reviews and if someone is looking for that attorneys number they will see tons of negative responses from ls1tech.

also, send the old attorney a notice that if they dont follow thru with it, you will contact the bar and file a complaint for each problem, you will file with the judge that handled the case and pursue legal action.

I believe she is going to file a complaint with the Bar regardless. No need to voice it. And as much as I would love to smear this guy's name, I am not going to co that, much less on the internet. Thanks for the offer though.

ok, just talked to an attorney and it has been too long to take him back to Div. Court and sue for breach of contract, much less contempt.

I think her only options are these:

1. Get him to refinance the house and get her name off of the deed - with an "assumption clause" referencing the BS decree. Pay closing costs, etc...

2. Since the property is still half hers (still in her name too) sell the house, or atleast attempt to do so - I understand both parties must sign the final sale documents.

But I dont think he will do either, because he is both a shitbag alcoholic and is worthless.

So, I think (and giv eme FB and let me know if there are grounds to do this)...

Put the house for sale, if he refuses to do it, then ask him to refinance the property and get her name off of it. If he refuses to do either take him to Civil Court.
