Default Law in Texas about Nitrous

Is it against the law to have a full Nitrous bottle in your vehicle attached by the line to the kit?? I have heard it is. Yes or no ??? Somebody tell us the law.

i think its considered 'possession of a controlled substance'

i dk what the law is but i would think it just depends on who pulls you over.

If the cop wants to be a dick he can say you had the intent to street race. How would they know unless you have the bottle in the open. Just put a gym bag over it and make it look like a bag with crap in it.

this is what I have been told by a few officers about my Nitrous bottle being full and in the car, they have all told me I can have it in the car, mounted in the brackets, and filled, but if I am on driving on the street the feed line is not supposed to be hooked up to the bottle and the valve has to be shut, other wise it's a "Illegal mod" ticket if you get pulled over and the cop feels that he should issue one...but I had my bottle in the rear hatch area so it was never seen if I got pulled over, only at local meets and when they decided to search every ones cars

the 3 DPS I ask said no laws on books in TX about nitrous, aswell as local PD and sheriff
ps: this may just be in my part of the woods, but I would not worry about it in any way

If nitrous is illegal then so is a turbo or supercharger...breaking the law by having a power adder, might as well remove my cam.

Alright guys, having legally obtained vehicle nitrous is NOT illegal to have or use, unless you are engaging in a street race. Having it in the car can be construed as intent, but there is no law about intent to street race. You either are street racing or not. Hell, my car suggests to half of the population over 40 that I have an intent to street race. But being a DPS Trooper, I know my career would be over if I ever did that, so I don't. I was contemplating running a Dry Kit for track use, but changed my mind. I wouldn't have gone through the trouble of unhooking stuff.

Now, illegally obtained medical Nitrous is illegal to have and use and is considered a Controlled Substance.

yup, that's it right there. this question came up before and i researched the laws a bit, and the only thing i could find pertaining to this was a law about possessing the medical stuff with the intent for using it as a drug.

Its not the fact that its a power adder, its the fact that you have a bottle of compressed gas in there; even though it isn't flammable or anything.

WstTexas just answered the OP's question anyway.

My brother-in-law works for HPD and he says it's not ilegal to have in the vehicle.

Yes, but it has to be a hazardous material to be of concern of legality.

If a bottle of compress gas were illegal, all of the compressed natural gas vehicles would be illegal so I don't think that's true.

When I asked about it I had a local cop tell me that basically it isnt illegal to have, but you can't use it on the street. He basically said keep the valve closed, and you wont have any problems.

it doesn't have to be flammable to be haz mat. nitrous oxide is a hazardous material, class 2.2 non-flammable gas, and it is also an oxidizer, class 5.1. if you were carrying more than 500lbs or were carrying it in a bulk container your vehicle would need to be placarded

but just on the safe side maybe they should put a placard on the vehicle just to cover themselves...

Nice to see cops are still bs'ing people about nitrous to scare them. I got pulled over 5-6 years ago, and the cop tried to tell me I needed a special inspection sticker for nitrous........
