I thought this would be some interest to the LS1Tech Texas members as it is happening in your own backyard. To prove the fact that this is an actual case, here is the actual civil court register of the filings;

It is a case being brought against GM, Michelin, Corvette Racing, and Doug Fehan regarding the 2008-09 ALMS season and the collusion of GM/Michelin/Corvette Racing/Fehan against selling tires and allowing for FIA homoligation of the Riley chassis to race at Le Mans, etc.


In talking with Lou @ LGM, he provided the full text for the petition, found here;

It is a very interesting read, here are some highlights;

paragraphs 18-43 background story of GM agreement to have LGM join GT2 in ALMS

paragraphs 45-49 causes of action

Count 1- restraint of trade in violation of the sherman act section 1 and the texas free

enterprise and antitrust act of 1983 (page 12)

Count 2- Attempted Unlawful monopolization in violation of section 2 of the sherman act and

the texas free enterprise and antitrust act of 1983 (page 14)

Count 3- Unlawful monopolization in violation of section 2 of the sherman act and the texas

free enterprise and antitrust act of 1983 (page 17)

Count 4- Texas unfair competition (page 20)

Count 5- Tortious interference with prospective contractual relations (page 21)

Count 6- Tortious interference with existing contract (page 22)

Count 7- Business Disparagement (page 22)

Count 8- Civil Conspiracy (page 23)

Count 9- Appliaction for Injunctive Relief (page 24)


Exemplary Damages
paragraph 110- "...LG Motorsports seeks and is entitled to recover exemplary damages from Defendants in a sum within the jurisdictional limits of the Court."



The background reads like a hollywood script, but it will be very interesting to see how this story unfolds going forward.

I'd have to say that was the most interesting lawsuit I've read. Seems like Lou has a legit case, if they do indeed have the proof in hand. Pretty shady stuff going on, trying to eliminate the primary contender by cutting off tire supply. Shame on those involved!

Lou has been on the short side of the stick many times. Hope he wins this case. Auto racing has become like everything else. Corrupt. If you are a small time racer or have a small team and become succesful the powers to be will find a way to make you noncompettive. Usually by changing the class rules so your equip. won't fit them ,or with holding parts ,or finally technolgy.

GM didn't want the privateers beating them and making their factory team look bad.

They need to first learn how not to run into each other in the pit imo.

I really dont understand why Gm wouldnt embrace and encourage the chance to have another GM vehicle out on the course competing with some of the top competitors in the world. Its not like LG would steal sales from GM or anything. And michelin is doubly at fault for douchebaggery because thats a really punkass move to not allow LG to not only not purchase their tires, but to not even run their tires purchased from another seller on their car. If I were michelin and GM had come to me and asked me to withold tires from a competitor, id be really tempted to withhold them from GM. But I guess I have more morals than most and would suck at running a multi billion dollar company.

Everything in our country is turning to **** even our damn hobbies. I hope LG wins this one, but now that its Government Motors I could see them winning this case just b/c.

That's really shitty, I really enjoy watching Lou's car and the C6.R bomb around the track, but looks like GM is up to some shady stuff.
