I get codes C0550 and C0896 on mine, which some speculate is the EBCM. My 3rd brake light is working but I do have a fog light out and I have seen a thread somewhere stating that could be the cause, so it will get replaced today before I go spend the $$$ on the EBCM.
EDIT: My car is doing just about the same thing. I start it, no lights. I drive 35 miles one way to work and they will come on, the timing isnt consistent thou.

As far as I know auto parts stores only have code readers, and those will only read the PCM
If you can drive for a while without the lights coming on then it's not the tire sizes, if it was it would trigger the lights consistently each time you drove it, and it would wait until you started rolling to do so. I didn't have problems with mine until I had 25.5" fronts and 28" rears.
Sounds like you have a power supply issue to the module or a module that is failing. They are a bit pricey but extremely easy to replace. Pull and inspect all fuses and relays for the ABS system and look for corrosion
The yellow brake light and TCS light will not cause you to fail and inspection but the Red BRAKE light will.

I bought some new rims and tires that I preferred so I don't have to run a spacer on the rear. I'm hoping that might possibly fix my issues even though I highly doubt it. I had planned on taking it to 5w20 to get the code checked but with the weather I have been hesitant not knowing what might happen with the weather

I would be more concerned with the differentiation in diameters of the tires

Also try unplugging the module, inspecting the connector and retrying it. Sometimes the connections get crappy from the connector sitting in one spot for so long and if you unplug and plug the connector it will renew the connection/clean the pins.
The reason I think it's a module or power supply issue is the ABS system (air bags do this too) goes through a full system check on startup, and if there is a failure at startup it will kick the light right away, if not it'll wait until the failure occurs. Being that yours is inconsistent and comes on at startup, while driving or not at all makes me think it's not a wheel speed sensor, but it surely is possible, if it's reading that one is an open circuit for example, but if it was a code for the sensor just not reading the wheel speed, the light would wait to come on until you got rolling each time.
