Got Arrested! i need advice

so guys i got pulled over last night for not having a working plate light in the back!? crazy i know, the cop took my license and 5 minutes later told me to step out the car, and he arrested me for driving with a suspended license :( I had no idea my license was suspended, and according to the state its been suspended since may. the state never sent me a letter or anything! now i have to go to court 2 days after i start college, and hopefully i can get a restricted license or something for work & school. i called the state today to see why i wasnt notified about it and they said it was sent out and i was suspended for a year. plus it cost me $130 to get my car out of the inpound! this really sucks. Have any of you guys ever dealt with anything like this? especially for you guys in Illinois, please help me out i need some advice

rimrat12 09-11-2006 11:51 AM

Best Advise someone gave me here was get a lawyer...

nokeman 09-11-2006 11:54 AM

Definately get a lawyer...a good one who works with specifically with driving offenses

phantomzer0 09-11-2006 11:55 AM

Damn right. The thing is, most cops will tell you to straighten your shit out, especially if it's your first warning and you were unaware. 99% you should know that your shit is suspended though. Did you pay all your tickets? Miss a court appearance? Best thing to do is get a good lawyer and you should be good to go.

NBMgreg 09-11-2006 11:57 AM

some good advice would be to move this thread to the appropriate section.

other than that, get a lawyer. or somehow prove that you were never informed of your suspension, why did they suspend you anyways, previous offenses?

98NBM 09-11-2006 12:05 PM

i'll move the thread over shortly

i had 2 speeding tickets which were only like 2 weeks apart back in april and the state said they sent the letter out in late april to notify that it would be suspended starting in may. the cop didnt even seem to care that i wasnt aware of it anyway, his excuse was he didnt want his supervisor up his ass

IBTL!!

6spd97ta 09-11-2006 12:19 PM

first off get a lawyer. it will help you out more and end up costing you less in the long run
second find out the reason you have been suspended ie tickets or unpaid fines.
it will take time to straighten everything out. this is not an oven night process.

been there done that twice :emb:

krink85 09-11-2006 12:20 PM

I got a ticket in Illinois for my liscence plate light not working in my Z. And if you just wiggle the wires where the light is, the light turns on(bad connection). I showed it to the cop and he said too bad, it wasn't on when I pulled you over. pigs in my town are dicks

Cephiros 09-11-2006 07:59 PM

that happened to a freind of mine as well as myself for court date, this state sucks ass abotu gettign otu paperwork yet the agressivly argue that they did, lawyer is your best bet about getting out of the driving on suspended licence, good luck on the rest perhaps the lawer can do that too.

americanmuscle13 09-11-2006 08:16 PM

just get a lawyer and tell him what happened

bowtieman81 09-11-2006 08:24 PM

Why was your license suspended in the first place? If it is because you did not pay your tickets then you have nothing to complain about IMO. You knew you had 2 tickets, you should have done something about them.

98NBM 09-11-2006 09:52 PM

alright guys thanks for the comments and i should have said this first when i posted the thread, i paid allllllllll of my tickets! believe me i hate cops and hate dealing with the court system. so I have a whole lot to complain about because i paid both tickets off back in april. in IL if you get 2 tickets within 24 months you get suspended, that was my 2, which were paid. they screwed up by not sending me my notice.

02 BLK WS6 09-12-2006 08:11 AM

How old are you???? Must be 16 to get your license suspended after 2 tickets. You are on what is known as 2 yr probationary period because you are a new driver. IL is very relaxed on giving court supervision and keeping things off of drivers records. They get more revenue by doing this. Spring the extra $$ for supervision and if it is a major violation, get a lawyer.

Matt D 09-12-2006 03:25 PM

I thought it was 3 moving violations in one year. I am pretty sure that is what they are going by now.

bowtieman81 09-12-2006 03:35 PM

Well, then it seems the state was at fault for not sending a notice. However, I know of no law that says you get suspened for 2 tickets in 24 months. My friend tim has had 2 tickets in a year before and he has never had his license suspended

2000slpss 09-12-2006 04:21 PM

if you are under the age of 21 you get suspended if you get 2 moving violations in a 24 month period. when you turn 21 you are allowed 3 movers in a year. its the graduated driving bullshit. im trying to keep from getting suspended right now. i have court next month and im going with a lawyer thats for sure

bowtieman81 09-12-2006 04:22 PM

OK, did not know that. They did not have those rules when I got my license. Does that mean I am old :jest:

Asmodeus 09-12-2006 04:48 PM

Looks like you may get out of the money for the driving on suspended liscence ticket, and get that charge thrown out, but you're likely stuck with a suspended liscence (from the previous infractions) and the impound fee.

dug 09-12-2006 05:58 PM

fuck the police

98NBM 09-12-2006 06:01 PM

im actually 18 going on 19 but like 2000slpss said if your under 21 with 2 movers then it gets suspended, my boss said i can probably pay to get the suspension off my record and get supervision, thats what im hoping for. i know im screwed on the impound fee, not really concerned about that, just the fact that i was never notified about the suspension is what ticks me off. if it stays suspended like it was supposed to, then im lookin at may of 07 to get my L back

Yeah I didn't know about that shit either. Must be new. All the tickets I ever had were from age 16-18 (that was 10 years ago) and my DL never got suspended.

The kids have it rough these days. :D

austin21 09-12-2006 08:16 PM

move to indiana we dont have that dumb ass shit here sorry about your car man cops are fucking assholes you just caught him on a bad day ..

Pro Stock John 09-12-2006 08:26 PM

Get a lawyer if you have a court appearance. You can be upset you did not get a letter but that's in the past now. I hope you are not driving now.

shit man that better not be in the past! im hoping thats what'll get me outta this mess, and actually my parents have been talking about moving to indiana lately since we're already on the border, maybe im meant to have a better driving life there

JRracing 09-12-2006 10:11 PM

I've seen this happen a few times. Bad luck.

Pro Stock John 09-13-2006 09:16 AM

You won't get a break with the 'didn't get a notice' defence. They will say well you got the tickets. Do you have a court date? You need a lawyer.

The Butcher 09-14-2006 03:42 AM

Well, I live in Indiana, and I have 24 points on my liscence. An...legally... you lose your liscence hear at 8 pts over a 3 year period. I'm jsut good like that...haha, had an interveiw with the pres of the IN. BMV...talk about ass kissing!!! lol
