what to do? i pay the owner for the car, get him to sign and hand over the title, then go register the car sometime later without him being there? i just want to make sure i get everything i need from him besides the car before i leave the old owner. thanks.

Sounds right, FYI some states require prior owners signature on the title to be notarized

Type up a Bill of Sale, stating the vehicle VIN#, TX title #, mileage, year/make/model of vehicle, and the amount you purchased it for. Have seller sign it, and you sign it. Probably should make two copies of that, let him keep one.

Seller fills out the buyer info on the back of the title, signs the back and the front of the title in the seller locations.

Take the title and bill of sale to the place where you get your registration stuff done, and pay your sales taxes (6.25% of selling price), and register the vehicle in your name. If you know the seller well, have him write up the bill of sale amount for much less than you are paying, but not much lower than book value. Thats what most people do, to pay less taxes on the sale.

I thought you need a title transfer paper, too. I think you can print it off TXDOT website...

Also, is the car financed? If so, that complicates things a bit.

The bill of sale is a good idea, but not required.

Might want to look here http://www.dot.state.tx.us/vtr/vtrreginfo.htm?pg=form1

Or you can just go down in person and they will give you what you need.

you can use a bill of sale in lieu of the title transfer form
