So this is my first accident in my formula after my v6 was totalled by a red light runner. I was going out of my school parking lot when some kid in an f150 pops a dent in my quarter panel because he backs out when im right behind him, his family is gonna pay its about an $850 job.

Now his mom is saying it could be partially my fault because she said "you didn't even honk when he was gonna hit you" which is rediculous. Thoughts?

Thats bull. I know FL Law and I'm pretty sure it is the same for GA when it comes to this. A person backing out has the responsibility to use due care.

If you were backing out of a parking spot and hit a car, you would be at fault since you failed to use reasonable care when backing out of your spot. Even if the person may not have had their lights on or were driving very quickly, because they had the right of way, they're not at fault.
