Fuzzy area here. Sounds like you may not know positively whether the car is in park. MAYBE. But suing for not actuating the brakes while the door is open and the car is in drive is madness. Another example of keeping the stupid people alive. Shame about the kid, but he DID get out without being sure (obviously) that the car was in park. And what did he think the rubbery, rolling sound was as it sounded like it was getting closer. Just sayin B.

Eh, I think if you're gonna design a shifter that doesn't have a mechanical shift into park, you need to have some kind of safety valve like engaging the parking brake if the door opens. It's just bad engineering otherwise.
