HPD re-issuing tickets
I had court on Monday where my ticket was dismissed. Now they reissued the same ticket and I have to go back to court.
Apparently they can re-file any ticket for 2 years.
Anyone else experience this or have advice?
I have David Sprecher already and I get a 50% discount on the re-file. lol

I'm not th expert on this, but I believe double jeopardy is when you are punished for something twice...not simply filed twice. He didn't pay the first, so maybe they are allowed an appeal of sorts?? Just spit-ballin' here! Either way, that sucks.

My lawyer said they can do it to anyone. Apparently this has happened to a few people in the last week, I guess Houston needs money. My lawyer will probably reschedule it for 2 years from now and then when it gets dismissed they can't re-file.

Double jeopardy is a procedural defense that forbids a defendant from being tried twice for the same crime on the same set of facts.....The defense of double jeopardy also prevents the state from retrying a person for the same crime after he has been acquitted. Nor can the state voluntarily dismiss a case after trial has begun in order to start over. Acquittal in one state or nation does not, however, always bar trial in another

the thing is OP didn't get acquitted. the ticket got dismissed. he was not proven innocent or guilty, the court just agreed to stop pursuing the charge.....for the time being.
basically it is a loop hole created for officers that **** up when they write tickets. so OP what you were trying to do by utilizing one loop hole to have the ticket dismissed, like wise the court is using their own loop hole so the officer can fix the typo on the ticket and still be able to nail you for what ever you did. sux but thats just way it is sometimes.
