Yes. A cut-out doesn't do anything to your emissions except bypass everything when it's open... and the bypass part depends on where you put it and what it bypasses..
If it's closed, it'd be just like you didn't have one... And I'd say get an electric one if you can swing the $.. They're a lot of fun..
