If you're referring to when the seat pulls up in the rear and you have to push it back down into place, that's normal. Happened in every one of my fourth gens when someone sat in the back.
Well there is only one bolt holding the bottom portion of the "seat" down, so don't expect it to stay in place. But if this is that big of an issue to you, you can get those stick-on velcro strips and put one on the back of the seat and the other to the carpet, that should be more than enough to keep it relatively in place.
