Defective Wastegate?

Cool Defective Wastegate?

Wastegate is a Turbosmart Ultra-Gate 38mm. At idle its open, had it hooked up turbo to bottom port, stays open..tried blocking top hole, still open. Disconnected all lines and still open. Doesn't seem like its open alot but just enough. I started to unbolt the top to make sure there is tension and there was, its a stock 7lbs spring. What gives? This thing possibly defective or am I doing something wrong?

i think you're missing the sealing ring on the bottom.

there should be a ring that goes into the wastegate that seals the valve
