What to do...Moser sent wrong gears in 12 bolt

Here's the low down. I bought a 12 bolt w 3.73's from a sponsor about a month and a half ago. First it came with the 1310 yoke instead of the 1350 I ordered. They simply sent me one. I got everything broke in and took it to the track. I was having to hit 5th gear around 112mph. After posting here I found out that's the limit of 4.10's. Today I counted and I have 37 ring teeth and 9 pinion teeth = 4.11's??? Well on my last track pass(due to the wrong gears) I hit 3rd instead of 5th and messed some stuff up on my engine. I plan to call the sponsor tomorrow and go from there. Any other ideas on what I should do?

Yes, 37 divided by 9 = 4.11.
You can't blame the 4.11 gears for your shifting into 3rd by accident. Sorry, that's YOUR fault. People shift from 4th to 5th all the time without shifting into 3rd.
Call the sponsor. I'm sure they'll get you hooked up with the right gear. ....Just don't expect them to pay for your bent pushrods (or whatever you messed up on that 4-3 shift.)

if you can prove the 3.73 is what was ordered someone, the sponsor or the manufacturer will pick up the tab, probably not any install cost though since they will claim you should have checked it.. if its mosers fault, from experience they are good to work with on problems like that.

Well I wasn't figuring on them paying for my blew up engine but the facts are if the 3.73's were in there I would not have had to hit 5th. I'm sure they'll send me the gears but why should I pay for gear install? Does everyone tear apart a brand new $2500 rear end and make sure it's what they ordered?
So is he supposed to tear the heads off also, to make sure he has a 346. When someone sends you something brand new, I wouldn't tear it apart, and risk messing up the new seals. Why would he. The fact that me missed 5th isn't the issue that shouldn't have happened. Even if he did tear it apart, he probably still would have went to the track....

Very well said treegreen Z. When my stroker motor comes in I'm gonna tear it down and make sure they game me the right crank. I don't wanna learn the hard way again.
Well...since I am constantly reading posts about rear end noise and other 12-bolt problems that have surfaced, your damn right I'm gonna tear it apart and check all the clearances, and preloads, and make sure it is what it's supposed to be. I have been working on and building cars all my life, and have learned(the hard way)to never take anything for granted, especially when your dealing with large scale manufacturers.

I never got any spec sheet. Just the packing slip from the trucking company. Heck I wouldn't know what to check even if I did tear it apart hehee.
I don't want to get or start a battle here, but there is no way in hell I'm going to rip down my brand spanking new $2500 rear. I do lots of work on cars, small stuff mostly, but I still wouldn't do that. I completely understand that he "shouldn't" have had to shift into 5th if he had the correct gears, however he did make several passes. After the first pass if it wasn't right and you knew that, then you should have stopped, even though that is hard to do...hehe.
Does this situation sound like getting waranty work done at a dealer after you have installed some kind of performance part?? Just sounds so familiar.
