Exclamation Help!!!

i just traded my car in. i signed all the paper work, so did they. on the way home in the new car the dealer called. he said he wanted to call the trade off because he was unaware that my car had an after market turbo. i had told him it had one. he said he new it had one but did not know my car is not made with a turbo from the factory. i had an rx8. does he have a legal leg to stand on? im going to work with him because he did give me a nice price. thanks in advance.

Well I am not an expert on this, but it sounds like it is there problem and not yours. If it was the other way around they would tell you they disclosed everything with you and all sales are final and you knew what you were getting. That is just my opinion.

I say if you told the salesman its there problem. Hell, if you didn't it should still be there problem. They should'a looked at it.

Well I don't know anything about North Carolina, but I know for sure that in NY, once the car leaves the showroom its over, as long as you have a contract in hand there is nothing they can do. I used to sell cars at the highest selling M********* dealer, and went through alot of trades. We have been stuck with cars with nitrous kits because the *** salesperson had no idea what they are doing. If you tell this dealer to go screw, you would be the man and idol for millions of people that have wanted to screw the dealer back over. I think you should at least tell them that you are in a road trip and stall them for a while.

well if it is financed, the car is paid for when the contract goes through, but not by him. the only way that you can get screwed into trading back MIGHT BE if the car dealer is the financor.

I worked as a car salesman (new and used) for a few months in ohio and quit because I was disgusted by the crap they pulled. The car is yours. They are not your friend. Working with you and giving you a nice price was their way of baiting you and letting you drive off the lot was the bait. This guy from the start intended to pull this number just to get more out of you. I'm sure that he will tell you, if he hasn't already, that you can keep the car and the deal goes through if you just give him more money to off-set his losses caused by his mistake. He'll likely want another 1,200 to 2,600 depending on your finances which he undoubtedly are too familiar with. Tell him to shove it and if he interferes with the deal being processed that you will sue him and press charges for extortion or something of the suit. Before you talk to him call the better business bureau and file a claim against him and his dealership. Let him know you did. I'm sure that his used car manager appraised your car and whether you disclosed it or not is not important. It was their job to find it. In the end they have already taken you for anywhere from 3 to 8 thousand dollars depending on your financing and whether you leased or bought. You can't lose unless you roll over to their high pressure antics.

Personally, I'd tell the dealer to go pound sand.

You even went so far as to disclose this info to the dealer before hand. You did MORE than your part. Tell 'em to get fucked. If the salesman contiunes to hassle you, file a harrassement complaint with the local PD. Also, call the BBB as mentioned above.

Was this a GM dealer? If so, call GM customer service and file a complaint aganist the dealer in question. The dealers hate when you do that, because GM takes it seriously. I've done that before, they will open a case file and question the dealer. If they get enough strikes aganist them, they will risk GM pulling their brand name from the dealer.

It is thier job to inspect the car prior to accepting it as a trade. You did more than you had to by telling them it had a turbo for sure. Tell them you do not know what a "turbo" is, and that the deal is final. Hopefully they will then reallize that there is nothing they can legally do and will leave you alone.

**** 'em. You know if you bought the car without knowing it had an aftermarket turbo (for instance) they wouldn't do the same for you. Negligence on his part.

What bank do you have the finance with? I am sure that none of the major banks will cancel this contract, so as far as that goes "your golden". Like Prokill I was also a car salesman (in NY) and if you look at other posts from me you'd see that I ended that career because I too grew a conscience. We have had asshat salesmen take in cars that had nitrous kits or open exhausts and my store would be stuck with the car (which really means the next costumer is stuck with it). Go on and enjoy the car, read the contract thoroughly and if you are not sure, try to buy time by saying that your taking a road trip.
Better yet, wait a week, tell them that you took a few road trips and the car is shot, see if they then take it back.

their used car manager should have appraised the car, meaning he should have inspected it and looked up the value of the car, based on mileage, wear and tear, and OPTIONS, if he didn't realize what he was getting had aftermarket equipment, it is his own fault. i happen to know that Karpower (the program they use to get blue book) asks for such options based on the car entered in the computer. (my bro is the used car manager at the local nissan dealer) his fault.
