Default Troubling trans issue

So heres the long story, as short as possible.

155,000 miles and my 3-4 gears finally went out. So I ordered a new "performance" transmission from Trans Depot in Hudson, FL, everything was great, the price, the customer service, everything, but they sent a 4L65e so I had to switch out the shift shaft on the side of the case. No big deal.

Transmission goes in just in time for the memorial day parade in DC and by that friday (1 week since installed) it had been developing a slippage issue, refused to shift into 4th when WOT and finally I completely lost 2nd gear and 3rd was slipping bad. So I called them up, they told me I need to have it diagnosed, then removed, then shipped out before they would warranty it.

So my technician is a Trans specialist for a Chevy dealership for 23+ years and he does performance builds all the time. So he diagnosed it and heres what he found (keep in mind, we could not do a tear down as it would void the warranty)

Ratios:
1st 3.xx:1
2nd 2.xx:1
3rd 1.00:1
4th 1.2:1
(yes, 4th was measured as a lower gear then 3rd, which explained the problem of not shifting from 3rd at WOT)

Line Pressures:
Park/Drive/Neutral @ 75psi
Reverse @ 92psi

No metal in pan

Tech2 manual command of transmission confirmed that 2nd gear was lost, and 3rd was slipping (ruling out on-board computer malfunction)

Final ruling, possible trouble with band

So fast-forward, I gave the information and had the transmission removed, they paid for shipping and had it picked up and brought to them. I got a call a week later and they told me they took the tranny apart and that everything was perfect. The problem is my cars computer. I don't now enough about transmission to said theyre wrong but I also dont know enough to prove them wrong. So now its a catch22; have my tech rip it apart and it voids warranty, send it to them in florida and not be able to see for sure whats going on. So since they didn't find anything wrong with the transmission they want me to pay $150 to get it back and I'm ready to go ballistic.

Meanwhile, I have had my old 4L60e rebuilt with performance clutch pack, bands, shift kit, and stall converter so its ready to be put in. So I contacted the company and told them what im doing and that IF it really is a problem with my computer then I should experience the same issues with this transmission as well. They said "YES" so we'll see what happens.

So I want to get some opinions on this, think its my car, or the transmission that's the problem.

There are s lot of good shops out there, BUT this is why I like to stay with local guys if I can
