Implied warranty - imploding heads
There is an important concept under the law called implied warranty which has been around for decades. It is based on the fact that if you pay valid consideration for a product it should be free of material defects.
Yes, it applies to speed parts purchased for automoibiles.
I have read lots of posts on this topic and disagree with the statements that "no one warranties this or that speed part under this or that condition."
Well, I don't doubt that speed part vendors claim this defense and I assume many times buyers just suffer the consequences becasue they believe they have no recourse.
Look; the best solution for a bad situation is for the buyer and vendor to negoitiate a fair settlement resolution. This is best for BOTH parties becasue the vendor will suffer over the long haul, if it does not stand behind the products it sells.
That said; if a defective aftermarket cylinder head wiped out my motor and the vendor would not agree to a fair and just resolution, I would tell him to tell his side of the story to the judge.

No offense but go to go different racing manufacturers sites and read ANY of their warranties. Any additional consideration given to someone for damages other than to the parts themselves is out of the goodness of their hearts. NOT from any legal obligation on their part.
