Warranty Of Merchantability Do a internet search on this term. It means no matter if a warranty was given or not a product must perform the job it was intended to do. So if something fails, the seller must prove it performed it's intended job!!!! I can't sell a used car "AS IS" and it won't make it up the block. I would still be responsible even though "AS IS" was stated. It must perform. RAY
Will this help in our arguements on modding while under warranty? Maybe it's just late and I'm tired, but I don't understand what you're getting at.

FenixSS, What he is saying is SUPPOSED to apply to automotive warranties as well. The dealer must prove that the modification you performed CAUSED the failure you are complaining about. However, that RARELY happens and people rarely follow up on it with higher levels of authority....

This is for any product. If the seller states no warranty and you install it and it doesn't work they are still responsible to give you a new one. A product must perform the fuction it was intend to do. If it doesn't they must replace it weather it had a warrranty or not. RAY

Exactly. If you bought a junk yard head and it only lastest 50 miles, they would give you another one. You can't sell a product that doesn't perform it's intended function. Regardless of who did what to the heads, the seller is responsible. RAY

I have already stated that we will replace the heads.That was never in doubt.

Before this gets locked, I want to say my bit:
I dont believe that this thing is about the damages, I believe it is about customer service. The thread originator wasnt screaming because his motor wasnt being replaced, he was screaming because of the way he was treated, and the time it was taking. Others are turning it into a 'full motor replacement' problem, when it started out only as a "Im pissed at poor service" problem.
