I'm glad I deleted my cruise control years ago.. I would have NEVER set the cruise at 100mph tho.. Your lucky to be alive tho.. If the car means a lot to you try and see if you can get a part off the car that still has some paint on it and hold on to it..

Am i missing something? What did the op do that would be illegal or cause a civil lawsuit? If i wreck my car and its disabled in the roadway. Isnt it the responsibility of the other traffic to be wary about hazards in the road? Sounds like this was at night etc so makes it more difficult, but at this point he is injured and the accident scene is mere minutes old. The semi driver plows into a stationary vehicle at 70+....just wondering if perhaps there would be a counter suit against fed ex.

surely a sad situation and glad to have walked away from it. Ive got a car that ive entertained getting rid of if interested.....

If he just changed his 100 mph cruise control in the story to be had his cruise control set at posted speed I would think he would have nothing to worry about.

Also the FedEx truck doing 70+ is not a fact, not on radar. Just the opinion of a individual.

OP admits he was going 100 mph. In most states that is a 2 point violation, impound car and take you to jail. The speed was a factor in him losing control of the vehicle.....

If any of the insurance companies involved find his post....their lawyers will use it against the OP. Reckless driving or whatever they will point to him as fault....which is why some of us are suggesting OP delete at least that portion of his post.

IDK if police responded and any report was filed....which may also have 411 in it negative to the OP. I am assuming OP did not tell anyone on scene he was going 100 mph but evidence of his initial impact to the guard rail may indicate to a seasoned cop that the car was going way faster than the speed limit when he hit it.

Each insurance company involved will try and put fault on the other so they don't have to pay claim

Yeah chances are slim any investigator is going to find OP by his screen name on this forum and see this post...but if any similar comments were on his Facebook or other social media...it is becoming SOP for investigators (especially his insurance company) to see if they can find anything that would be reason for them NOT to pay the claim

Anything the o.p. has posted in text on the interwebz would be something any attorney could get tossed out without even wiping the sleep out of their eyes. (This doesn't include any threats made against someone...)

In court, pictures rarely lie. The written word on the internet - especially social media platforms - usually does - and as such, it's pretty rare when it is given serious consideration in cases. I.E. "Your honor, my client's stated speed on Ls1tech.com was a fabrication, just to make himself look like an internet bad-boy. He has since told the court that he was doing 55 miles per hour and recants his earlier statements". (The only time its used with success is when there are other elements added to the evidence file and the social-media posts are used to bolster an already strong dossier. )

That's all you need to establish doubt in a criminal case, and the standard for conviction is "beyond a reasonable doubt".

Edit:
Now if there are videos of the OP doing stupid **** in the car somewhere online, that's a horse of another color and would definitely be used in any court case to establish a pattern of behavior that's consistent with whatever picture the prosecution is trying to establish. I see videos all the time of idiots doing moronic stuff in cars that anyone who fogs a mirror could tell is illegal, yet they do nothing to obscure the tags. Matt Farah of the Smoking Tire is one such dimwit. In these cases, prosecution would be a cakewalk.

Lawyers always caution their clientele to not discuss anything to anyone at any given time until there has been resolution. And "beyond reasonable doubt" also depends on how good the attorney is. It's just far better to not say anything on any public forum, however I'm sure this story has been plastered all over the place so there's no reason to caution the OP any further. I'm just curious to see if there have been charges filed...

There's nothing that can be definitively proven - specifically video evidence - but apparently there's enough content to establish an apparent pattern of behavior. In the hands of a competent attorney, that's all you need to make your life very, very uncomfortable in defense. Now if the police on the scene conducted an accident investigation, they may have been able to determine speed due to skid marks and the debris field. If that was done, I'd think they'd have already charged him.

The OP likes to live dangerously (looking at LT11996's post). I hope he either learns from this episode, or doesn't take anyone else out in his next accident.

I've lost a sentimental vehicle before, those are the worst to walk away from in a scrap yard. However, at least you walked away. I read an article just this week of two people up my way killed in a Camaro when it was rear ended by a Yukon on the highway. I also met a guy who grew up with one of my college roommates, he was spoiled by parents who had a lot of money and bought him a v6 Firebird for his first car. He was never into cars but thought he was cool with his big bad 3.8 and drove like a maniac everywhere until he put it through a telephone pole and a girl in the back seat shot like a rocket out of the rear hatch glass. Luckily, she survived.

Damn OP thats one helluva story! Your lucky you didnt kill anybody from that. Yeah driving without a seat belt no biggy. and yeah it may take forever to go anywhere in FL so speeding is the norm. But to combine all that **** together. Wreckless.

Just to expand on this further, in a civil trial the standard is lower, it is only the preponderance of the evidence. We can look at OJ Simpson for a real life well known example, sure he was found not guilty at his criminal trial but did lose his civil trial.

OP, glad you are alive and no one else was seriously injured. Perhaps use the cruise control next time though to keep you out of trouble, I know that is what I use mine for, to keep it around 5 over on highways. Crazy thing, haven't had a legitimate speeding ticket since 2003. Got one in 2009, up on 301. Jokes on them, they aren't a law enforcement agency anymore. They got disbanded by the state from all of the complaints over the years.

Unfortunatly they dont make those american racing wheels anymore. Will never have a set like them btw you might like the passenger rear wheel better. No joking it was shaped into a heart sitting in the back seat. 18x11 forged wheel. Tomorrow is valentines day and wish i could of gotten that wheel out to give to my fiance but was jammed in the car. Anyone know how to delete this thread?
