w.o.t shift down at 40 mph

w.o.t shift down at 40 mph when imcriusing in drive or od and go wot sometimes it
goes like hell and other times it lays down, im wondering if this is the torque
converter settings. if its under 40 it always goes like hell but over that
and it lays down. not cool if i try and make a pull on somebody abouve
40....
