Texas Insurance Question

Default Texas Insurance Question

A person driving a rented vehicle rear ended me last week. After filing a claim with the rental company's insurance carrier, they have informed me they believe her personal insurance should pay. The driver disagrees because she believes she purchased the appropriate liability coverage from the rental agency.

Am I correct that it shouldn't matter? The rental company is required to keep a liability policy on any vehicle being rented for use in Texas? My feeling is they should fix my car now and hassle with her on their time?

I'd let your insurance company know about it and let them sick their lawyers on them. They will get is straight faster.

Not interested in involving my insurance company. Total damage is $524.

the liabilty portion of her insurance will cover the damages to you vehicle, she does not even have to have comp of collison, just liabilty only, if she took out the rental protection plan from the rent a car company, you can contact their loss control department and file a claim, depending on the company

I understand the differences in liability and comp/collision. After the accident she informed me that she paid the for liability on the rental because she does not have insurance. I have contacted the rental company. They forwarded to their claims management company. Claims company says renter did not take out the specific coverage that would pay for damage to my vehicle and that the renters personal insurance should pay.

My position is that I don't care. The rental agency should be liable either way. If she does have insurance and is lying to me, then they need to prove it, otherwise the insurance they maintain on their car can pay for it. If they let her drive their car without mandated Texas liability coverage, then again, their insurance can cover it.

Have them provide you with a signed waiver she HAD to initial to decline the extra insurance. That lady likely has the rental reciept which will show wether or not she purchased that coverage. If she did, there should be no arguement or inaction on their part. It's their duty to prove to you she didn't get that coverage. If they cannot prove that by producing evidence they must provide the coverage.

Ramairta is also correct.

First Post ever..... If she paid with a credit card it may offer coverage on rental cars. Good luck.
