Needing Some Advice
So, as a couple people on here know, I put my car in the shop to be repainted last April. He turns out a lot of ins. jobs, and was to be working on it as he could. Well, here we are in almost July, over a year later, and the car is still not done. He said it would be finished this past Saturday, said he had the back bumper to put on and some interior stuff, door panels, etc. He took the car apart to paint it correctly. His shop electricity was turned off for a while (may still be) his shop phone is now disconnected, and it appears he has gotten on the "white dragon". I want the car finished, I don't have the time or desire to go load it up on a trailer if it's in pieces still, I want it exactly like I dropped it off. What would you do, and is there any legal action I can take? This is crap, I've missed another car show season, and spring riding time!

I'd go get it and make sure the car is all there. If no money has exchanged hands then you aren't really out much more than time and frustration. It would suck to leave it there and then drive up there later to find the engine / transmission missing because he needed to feed his habit.

That's what I would be worried about- things get 'misplaced' all the time.
I understand him keeping the insurance jobs in front, they only pay for a rental car for so many days.
Still- been quite a while. I would pick up the pieces (literally) and move on.

well, I called the local sheriff's office, the are aware of his current problems, a couple of other people have called as well. they directed me to the justice of the peace, who had also received 2 other calls on this shop. basically, the police cannot just go out there and demand him give me my car back, since it is considered a civil manner, the constable said he would go out and talk with him "again" and see about letting know what will happen and hopes he will finish my ****.....

Cut your loses man. Just get your car back even if you have to pay the guy some money for the work he has done. I have seen peoples cars tied up for years due to legal issues when a shop goes out of business. Just get it back now.

that's the route I am going to go, called him this morning and told him he's had more than enough time to finish it, figure out what I owed him for what he has done and I'm gonna come get it and take it somewhere else to have it finished. We'll see if he calls me back....
