harris county laws on marijuana possession
my friend just got a class b misdemeanor for 0-2 oz of bud, he only had 2.8 grams but he has a prior offense of burglary of a motor vehicle. anybody have any idea on what his punishment will be. ive heard everything from a 500 dollar fine to a year of probation.

This isn't a great place to get busted for pot, unlike Denver! Hell yeah I-100!
My buddy Sean got busted for the same thing, he received 1 year of probation with mandatory drug tests every so often (and they actually did test).
Edit to clarify on I-100:
In Denver it is "legal" to have up to 1 oz of pot on you. Pot is also decriminalized in Denver. Contrary to popular belief this does NOT mean I can just walk around with a bunch of pot and laugh at the cops in the Denver city limits since it's still against state law. All this means is that if a cop really doesn't want the hassle of dealing with someone who has a bit of pot on them and isn't doing anything all that bad, he can just let it slide and say that it's "legal" in Denver so he isn't legally obligated to do anything since the laws conflict, at least that's how I understand it.

It all depends if he pleads guilty and it goes to trail. Then the jury will decide if he is guilty or not and they may bring up his prior conviction during sentencing stage if the jury finds him guilty. Usually in cases such as these the county does not want to spend the money on putting a jury selection together therefore the DA will offer him probation, deferred adjudication or a lesser conviction and the judge will make him take drug classes and community service a part of his probation. The county gets hundreds and hundreds of midemeanor cases like these each day so they dont want to spend the time and money in actually taking these cases to trial. They only want to try Felonies and capital offenses.

if he's smart, he will plea. Don't jump on the 1st offer unless it's doable, but definately don't take it to trial. Judge will get pissed off you are waisting his time for a bs class B.

(a) ...a person commits an offense if the person knowingly or intentionally possesses a usable quantity of marihuana.
(b) An offense under (a) is:
(2) a Class A misdemeanor if the amount of marihuana possessed is four ounces or less but more than two ounces;...
Section 12.21 Class A Misdemeanor (This is in the Penal Code).
An individual adjudged guilty of a Class A misdemeanor shall be punished by:
(1) a fine not to exceed $4,000;
(2) confinement in jail for a term not to exceed 1 year; or
(3) both such fine and confinement

thanks all you other guys for your comments.
i just hope he doesnt go to jail cuz he has too much to lose now. back when he got arrested for that other **** i didnt even know him and he supposedly has straightened up alot since then..except for the pot i guess
