Rubbing where? On the palstic wheel well liner such as this:

If so I wouldn't worry about it.

Changing the aspect ratio of the tire will make the tire shorter, and potentially case the ABS computer to be unhappy since the overall diameter of the front and rear tires could be off too much.

The OD of the tire would be reduced by .97" . . . or nearly 1/2" of the overall sidewall height.
So it would cure the problem probably then right
I honestly have no idea . . . quite possibly yes, but may creat a bigger proble, with the front and rear sidewalls being near 1/2" diffent in hieght, which has been know to disrupt the ABS fuctionality.

It "shouldn't" . . . but it all depends on the offset of the wheel. . . .

I believe the rims I will be running have a 38 MM backspace of offset.

The offset is what is causing the rim to rub. A guy had a 245 40 18 with a body kit on it, I will say he wasn't the smartest kid and cut the front of the side skirts were the push pins go in, and added some rigged self tapping screws to hold it on. I would not recommend doing that. Find what the offset is and go from there.
