I have a better idea. Have your girl dial his girl from a payphone. Tell her to ask for him by name. But make sure he isn't at the apartment when she calls. Tell her to ask if this is his sister answering the phone, because its his girlfriend calling.

If he's on the first level, run a garden hose under his door, plug up the crack with towels, and leave it running all day while he's at work. Someone did this to my neighbor at my old apartment.
If you're going to fight him, talk lots of **** and get in his face alot until he throws a punch. Take it like a man and you're golden. Make sure there's a witness though, and you should be able to legally kick the **** out of him.
