Should I let bodyshop replace entire back end?
A few wrecks ago i was rear-ended (wasnt my fault, he got the ticket), and now the body shop is telling that they want to basically cut from the back of the rear seats backward in order to replace the entire back clip. I think thats just to much and that it should be totaled. They've already told me there was frame rail damage. The original quote was $ 9.5K.
I had another thread for my wreck but I couldnt find it with search.

Should I let them do the procedure, or try like hell to get it totaled out?

I cant get any undersides. Its sitting outside the shop waiting on approval from Allstate. Probably the slowest insurance company ever.

You need to be talking to the other party's insurance adjuster not the bodyshop. That is who will determine if the car is totaled. They are usually quite agreeable when their insured is at fault. More importantly don't sign a personal injury release too soon. Injuries from an accident like this may not show up for several months. I would let the time to file a personal injury claim run out without settling even if you don't have any apparent injuries. That is more important than the car. If you can hold your ground for a while the adjuster will eventually come under pressure from his supervisor to settle this property damage claim and be more willing to negotiate. I've had to wait as long as 6 Mo. to get a fair settlement when the adjuster was a jerk.

Ill call allstate and get them to total the car. There is this black on black 01 Ws6 m6 that ive been looking at anyway. as for injuries my back has been messed up since birth and my neck hurt bad after the wreck. Still does to an extent. ive got a follow up with the doctor on friday.

I think it's funny how everybody says it will never drive the same. They have no idea what they are talking about. They listen to too many myths. It is repairable and yes it needs a rear clip. And yes by industry standards it is totaled if damage is 40% of vehicle value than it is totaled. I've rebuilt several cars, if done right you will never know they were repaired.

I agree that the car can be rebuilt to before accident condition "IF" it is done right, but if it bothers you, you won't be happy with it so get it totaled. As far as your injuries, having a previous back problem doesn't stop you from recovering damages for a new injury. You should talk to legal counsel if your back/neck continues to bother you. DON"T release any medical records to the insurance company, let your attorney handle that if you have continued problems, and take your time.

well i cant see an insurance comp. paying that much. I wouldnt let them do it at all... it would ruin the structure... now of course it can be done (with time and money not an option.) but think if you ever got in another wreck??? would you want any what ifs?? and I always thought that if the damage was over half of the cars worth then the ins comp would total it right off the bat.

The car is trashed , dude , total it. Then buy it back , part that mug out and get a really nice replacement for some easy wrench turning. Everything comes apart much easier than reassembly.
