If you paid with a credit card, you can dispute the charge. He sold you a busted block. Stuff happens, it's why yards have return policies. If they're trying to keep the money without honoring the return policy, you have a strong case to dispute the charge.

I'm saying he was betting on the cracks not being found until the warranty expired. Hence his whole spiel about voiding the warranty because the heads were removed.

If he didn't know - dont thing he was betting on anything other than hoping the engine was good enough to not come back. The voiding warranty thing is the same thing as - we have a warranty as long as its installed by certified ASE shop. Well that doesn't happen 90% of time either.

Don't get me wrong - he should absolutely help find you another block or replace your $$ now that he knows. Just saying that's the way it works.
I'll be buying a engine here soon also.
Ill be doing compression, oil and rod bearing checks.
I may 'still' have to have it rebuilt if I find other issues once I install it .... as there is no warranty - and even if there was its likely to have expired before I get it up an running and find the problem.
Just like everything - always a risk when buying used.
I always try and get in writing stuff beforehand in case I need to refer to it. But most guys selling used are rightfully - check it out - but once you install it its all yours.
