Sorry to hear of your issues. Some FYI stuff: 1) you should file right away irregardless of waiting for the CC co. 2) you may have to file in the county with which the company with undelivered said product resides. 3) some large counties allow you to file small claims via Fascimile. 4) call the county with which they reside and find out...it's not tough at all. 5) get all your paperwork together and wait for your court date (usually 30 days or less from time of filing).

I've had to file several times for customers not paying. It's a quick and efficient system to resolve. The CC companies always drag their feet.

Another week, another update. I just talked to Marko on the phone, and he said that one of the first customers that have the kit should be charged the rest of the amount they owe the beginning of next week, and I'll be receiving that money as a partial refund. The rest of my refund will happen as more people pay the full amount.

I'm going to sleep on this tonight. He also said that his silent partner is pressuring him to not give a refund, since all they have to prove is they intend to deliver a kit. He said he gave his word that I'll get a refund, so he's still going to give me one. If some of the others receive a complete kit, maybe getting a kit and selling it will be easier than this BS.

Marko told me to call him yesterday (Wednesday), but he never answered the phone, and his voicemail is full. Same story today, guess he's watching his caller id. Voicemail is full at the shop as well, and nobody is answering of course. I haven't bothered calling Bill's cell, he's never answered it or returned my calls in 10 months.

 

It's been awhile since I updated this thread, still haven't received my money, but I've talked to Marko a couple of times since the last update. I might be receiving my money once people start paying HiFlo the rest of the balances, but I can't see that happening until they get complete kits.

 

Still nothing. It amazes me that most people still don't have complete kits, not even counting the A/C lines.

 

It seems you have done everything short of showing up at his private residence. I don't have that kind of tolerance - a month or two during peak season with limited materials but longer than that it would be me and Mr. Thirtyottsix popping in to say "Hello!".

You may have no other recourse than to file a small claim so there is garantee of payment no matter where it comes from.

 

Finally, a step in the right direction! I received a check in the mail today from Marko for just under 1/3rd of the amount owed. I asked and agreed to receiving payments. The plan is that I'll get the next 2 checks in the next 2 weeks. I'm going to deposit it tomorrow and cross my fingers for a couple of weeks. I'm kinda happy that I finally got something in the mail

 

Thanks for the detailed updates. He did say on the fone last week that a check did go out, so this time it was true.

Well, ****. Marko is back to not answering his phone, been trying for a few days. Guess no check this week. In other news, my credit card company finally got in touch with me, and are currently investigating what's going on. They had me send them a detailed call history, which shows how ridiculously hard it is to get ahold of them, and how long this crap has been going on. I'm surprised they haven't already rejected the chargeback!

 

More updates. I got ahold of Marko earlier this week, and he said he "might" send a check on Friday.
Here's the shocking news, I called my CC company today, and they said they issued a temporary credit for the $2340.67 still owed me. HiFlo has a chance to issue a rebuttal. I'm wondering what will happen now, I didn't expect the CC company to do anything

 

Well, looks like my ordeal is pretty much over after a year+. The 60 day period that HiFlo had to dispute the chargeback is over, and the credit card company is sending me a check + interest. It's good to hear that the last few people are getting the rest of their kits as well.

 

It has been an ordeal for sure. Glad to hear you got your money back.
