If it's out of a V8 car then yes it's posi. Since it is out of the car (assumingly) ask him if you can pull the cover and inspect it. If you're still skeptical of the gear ratio too you can count the teeth.

if it's only two miles away go check it out and spin it like ramair said. you'll be able to tell if it's a 3.42 vs a 3.23

def should be legal in street stock. any rear combo will probably be allowed. im subscribed as i also dont know crap about rears and i want to do work on mine b4 the shootout as well

I've got my stock rear out of my '97 Z28 I'm selling for $200. It is a 3.42 posi unit, 79K miles, great shape. No whines or groans. Complete...install and fill and drive.
Was a 4-channel rear, but has 3 channel backing plates = no abs. Which isn't a problem for you anyway.
