Default Problem with 04gtoBMXracer

I needed a set of 317 heads for my turbo motor build. On 9-18-07, I paid 04gtoBMXracer $400 plus another $30 payment for extra shipping for a total of $430. The parts consisted of a pair of the 317 heads, a GTO oil pan & parts, a water pump, and a pair of GTO motor mounts. He discovered the oil pan had a crack in it and told me about it prior to shipping. We adjusted the price by his adding extra parts accordingly.

The items were shipped out OK and I received them w/o any issues. I left a positive trader rating for him.

Here is the problem:

When I went to test fit the heads I noticed there were two exhaust bolts broken off, one in each head. This was not disclosed prior to the sale. One was above the gasket surface and one was below. I was able to extract the one above the gasket surface, but not the one below. On 9-28 I PMed the info to him and requested he refund $100 to offset the cost of another head less shipping (which actually cost me $168 from another seller).

On 9-28 he replied:
"sorry man I only notices the one that was sticking out, I just sent the request to transfer the money from my ba.k account it said it takes 6_8 days so right as soon as it gets in I will put it in your account. I'm sorry for the troubles man. I know stuff like this can be a real headache."

I thought at that point he was a stand up seller & I would have my refund within 10 days (allowing for the lag built into Paypal).

When I never got it, on 10-9, I PMed him to follow up on the status of the refund.

On 10-9, he PMed wanting to sell me two more "241" heads that had some damaged parts. I replied I did not need any more heads, that I had found another & just needed the refund to cover part of the cost of the replacement, which was actually $168.

On 10-12 I PMed and emailed him that I would accept a GTO AC bracket and working compressor if he had them since I was going this route in my build.

I have not heard anything back from him even though he has been online after that date.

I don't like having to post in this part of the forum and in nearly 30 deals here I have never had to. Unfortunately I am at the point where I'm having to file a Paypal complaint since it has been close to 30 days since I paid the money.

I don't think there was bad intent on his part, but the bottom line is I paid for a pair of heads that were usable. I received two that were unusable, and had to do extra work to get one head usable. I would not leave another member hanging for a refund once I knew there was a problem with something I sold. I expect the same in return.

When 04gtoBMXracer makes this right, I will edit & update this post.

Default Burned by the seller & Paypal

I filed the dispute and got this from Paypal:
Our investigation into your claim is complete. As stated in our User Agreement, the claims process only applies to the shipment of goods. It does not apply to complaints about the attributes or quality of goods received. Therefore, we are unable to reverse this transaction or issue a refund.

Typical considering they are owned by eBay.

For reference as to how I do business in a situation like this, I was notified by a purchaser at 10:18 last night of a problem with a part I sold. It was a similar circumstance in that it was a problem I was unaware of (a small crack in the pressure plate) that he discovered when he went to install the part. It prevented him from using the part. I gave him a partial refund before 11 AM this morning. I had no such luck with the guy that sold the parts to me:

Well the parts were ok when I shipped them. I don’ t mean to be difficult, but I just threw those things extra into the deal to help whomever bought it out. But when I shipped it, or crated it I should say, I looked everything over and it was all ok.

I just have to remember not everyone here works or thinks like I do and some don't really care about anyone other than themselves.
