TX Civil Case- LG Motorsports vs GM, Michelin, Fehan

I thought this would be some interest to the balance of the road race LS1Tech crowd. To prove the fact that this is an actual case, here is the actual civil court register of the filings;

It is a case being brought against GM, Michelin, Corvette Racing, and Doug Fehan regarding the 2008-09 ALMS season and the collusion of GM/Michelin/Corvette Racing/Fehan against selling tires and allowing for FIA homoligation of the Riley chassis to race at Le Mans, etc.


In talking with Lou @ LGM, he provided the full text for the petition, found here;

It is a very interesting read, here are some highlights;

paragraphs 18-43 background story of GM agreement to have LGM join GT2 in ALMS

paragraphs 45-49 causes of action

Count 1- restraint of trade in violation of the sherman act section 1 and the texas free

enterprise and antitrust act of 1983 (page 12)

Count 2- Attempted Unlawful monopolization in violation of section 2 of the sherman act and

the texas free enterprise and antitrust act of 1983 (page 14)

Count 3- Unlawful monopolization in violation of section 2 of the sherman act and the texas

free enterprise and antitrust act of 1983 (page 17)

Count 4- Texas unfair competition (page 20)

Count 5- Tortious interference with prospective contractual relations (page 21)

Count 6- Tortious interference with existing contract (page 22)

Count 7- Business Disparagement (page 22)

Count 8- Civil Conspiracy (page 23)

Exemplary Damages
paragraph 110- "...LG Motorsports seeks and is entitled to recover exemplary damages from Defendants in a sum within the jurisdictional limits of the Court."



The background reads like a hollywood script, but it will be very interesting to see how this story unfolds going forward.

Good luck to LG, it's unfortunate what Corvette Racing and Michelin put them through and essentially forced them out. Hopefully all this collusion can be ended and factory teams can actually support privateers...let alone allow privateers to even BUY a GT2 Corvette (which currently cannot be done)

Wasn't this also around the time that Katech was bounced from the engine program for Corvette racing?

Yes. When Corvette Racing moved to GT2 racing, they dropped their Katech contract to build the motors in house and try to save money in the process..that resulted in spending more money because they blew multiple motors throughout their first couple seasons, were often down on power when they were running, and even faced penalties to illegal motor modifications. Apparently Katech builds better race motors than GM; who'd a thunk it?? LG had already been racing in GT2 for a season prior and had a car built by Riley and thanks to GM was barely able to get it homologated. Right after, GM signed contract with P&M to build the Corvette GT2's and GM controls who gets to have a GT2 Corvette
