Smart Choice Warranty Problems!
Smart Choice Warranty Problems! When I bought my car new back in 2001, I purchased GAP and extended warranty. Well a couple of weeks later I cancelled these and recieved documentation of cancellation. Now that I am near my payoff, GMAC is saying I owe them the money for the GAP and extended warranty as they have zero records showing where I cancelled. GMAC told us to contact the dealership, the new dealership says they have no records either and I should contact the companies whom they got the GAP and warranty from. Well when I contacted the company the GAP came from they say they only sale TOOLS, and when I contact the warranty company I get nothing. The dealership says even though I have my records it doesn't mean anything since no one else has the same records. I did not recieve any money from this so I would only assume someone else did, but who is that person(s). I contacted a legal advisor and he suggested I only pay what I think I am liable for LEGALLY and stop payments. Let GMAC take me to court to get their money and sue them and/or the dealership and/or the GAP and warranty companies for the remaining payments (which would be the GAP and warranty that I cancelled almost 4 years ago). Someone forgot to do something and now I am having to pay. If anyone has had a similar problem please post up. I bought the car in Corinth, MS form Nunley Automotive which was bought a couple of years ago and now named Copeland Automotive. Any help would be appreciated, cause Im being held responsible for over $2,000, which isnt pocket change to me.

OK if you take this to court, show the leagal paper work that the "company" sent you when you cancelled... Since the company has changed hands and all of the records are gone and you are the only person w/ the paper work then you have a great case. If you went though GMAC to finance, then the dealer ship should never have even been brought up. GAP only goes through the finance company. It has nothing to do w/ the dealer. No matter what they tell you. The only thing that the dealer will have is the contract where you bought the car --- nothing else. That just shows them where they got there money. They dont give two ***** about anything after that. ( I used to work doing this kinda **** so you know) To get a really good opinion about this, go see a law dog... he/she can tell you all about it. I maybe in the minority but I think ALL extended warranty's are complete BS! In my business I deal with them frequently and these guys never want to PAY FOR ANYTHING when you need them. I know this is not what this thread is about but for future reference for you guys/..........
