How to hit the insurance company for loss of value?

damn thats a nasty hit. even if it gets fixed i think it would be time to move on . too picky to deal with the rattles, squeaks and misc other issues that come with a previously wrecked car.

Man, sorry to hear this happened. Wrong place at the wrong time I guess.

BTW, the insurance co already knows what the labor rates for your area are...so they pay you based on those. You ARE free to take it to any shop of your choosing, but that doesn't bind the insurance company to pay for it. If that were the case we would all have a buddy with a shop that conveniently charges $150/hr for labor...lol

Oh and as has already been stated, your car is too new for them to be able to push aftermarket or used parts.

TexVette: I'm surprised you could get that much on diminished value (38%!)...I mean if that were the case, you are at $35k total property damage on a $40k truck ... better to just total it. I'm thinking that was some creative settlement by the claims adjuster - more PD in leiu of a larger BI payout...but who knows...

Default Same problem

Man I now how you feel

My wife and I just had the same problem we just got a new 2010 Lexus Rx350 and it had 600 miles on it when someone rear ended the car. The car spent almost 3 months at the body shop and we are over 16k in damage. Just got the car back last week and I found some places on the car that still need to be fixed so I have to take it back for more repair. Very Frustrating

I don't know what all can be done on the diminished value and was hoping to find more out so let me know if you find anymore info on it

Be sure to hit them up for a rental car ASAP, let it rack up their costs. Also, pick an expensive body shop that does good work. YOU get to pick the body shop, nobody can force you to get 2nd quotes or go somewhere else.
I have a rental already. I am asking around to figure out where to take ot to body shop wise. Not much luck there.

On a new car a wreck like this deminished the value by 35 to 40 percent. I have been doing a lot of research.

I am dealing with an agency that handle the deminish value claim side. I am waiting for the insurance claim agent to come look at the car before I can move forward. From my understanding this company takes the repair order and then sends one of there specialist to evaulate the car as well. They then provide you with all the information needed to fight the insurance company for the deminish value. They charge anywhere from 299 to 599. I am just now trying to figure out of this is something I need to do or not. They have told me we are intitled to a 35 to 40 percent pay back.

To this day I cannot understand why folks do not get a lawyer after an accident.

1. Never trust any insurance company. They are all about saving money. ALL OF THEM.
2. Even though you think your insurance company will bat for you, you still need a lawyer. Fully trusting them is borderline naive.

To the OP, you need to get a lawyer. They will get you more money and ensure the insurance company will not try and play the games they play. If they are a good lawyer....

You can get the money for the loss of value since your car has been in a wreck but the offending insurance company will not want to pay you for it. That is why you need a lawyer who has passed the bar. Not the insurance guys who could not pass the bar...
