Not true in Texas. Even if he shot them in the back, as long as he is found to have been lawful in his use of deadly force, he is immune from civil lawsuit.

Damn straight it was his choice. and a good one. it was also the choice of those 2 ILLEGAL guys to go into someone else's house and take what someone worked hard for. if they weren't in this country this would NEVER would of happened. they broke the law as soon as they came here and obviously had no intent to better them self's.

I'm all for Joe Horns Actions, he just made the mistaken of calling 911 first and using the wrong words with the 911 operater.... He has spent all kinds of $$ in legeal fees and now has to come out of retirement to be able to afford to defend himself in the Civil suites....

i guess it is hard to charge someone with murder who is trying to defend themselves and or their property, or in protection of a third person. but the castle doctrine seems to be an affirmative defense against civil liability but not a complete guarantee...

yup your right he will. He will end up wasting a ton of money defending himself. Sucks how the legal system works.

Yup it does, but they can still try and sue him and he will have to defend him and waste tons of money in court, like I said above, sucks how the legal system works these days.

In addition to providing a valid defense in criminal law, many versions of the Castle Doctrine, particularly those with a "Stand-Your-Ground clause", also have a clause which provides immunity from any lawsuit filed on behalf of the assailant for damages/injury resulting from the use of lethal force. Without this clause, it is possible for an assailant to sue for medical bills, property damage, disability, and pain and suffering as a result of the injuries inflicted by the defender, or for their next-of-kin to sue for wrongful death in the case of a fatality. Even if successfully refuted, the defendant (the homeowner/defender) must often pay thousands of dollars in legal costs as a result of such lawsuits, and thus without immunity, such civil action could be used for revenge against a defender acting lawfully.

The only exceptions to this civil immunity are generally situations of excessive force, where the defender used deadly force on a subdued, cooperative, or disabled assailant. A situation meeting this exception generally invalidates the criminal "castle defense" as well. In addition, someone who uses deadly force in self-defense is still liable for any damages or injuries to third parties who were not acting criminally at the time of the defensive action
I'm not 100% on this, but from what I understand, if he is in fact justified in the use of deadly force, then a civil lawsuit is not even allowed to be filed against him. In Texas anyway, because our doctrine does have the Stand-Your-Ground clause.

The problem with that video / situation is the fact that it was another persons home/property and not his own. I understand why he did it but there are always differnt points of view and opinions. Whats stupid is they where "illegals". If he didnt want to face any legal trouble he should have fired in one shot in the air and im sure they would have dissapeared if they werent armed, the fact that he fired more than one shot and was still on the phone is what made it a contreversy.
