Effective October 15, 2008:
For vehicles year model 2001 and newer, we allow one (1) non-continuous monitor to be Not Ready and still pass the test, but two (2) or more Not Ready's will cause the vehicle to fail.
For vehicles year model 1996 – 2000, we allow two (2) non-continuous monitors to be Not Ready and still pass the test, but three (3) or more Not Ready's will cause the vehicle to fail.

This one, I think will be easy to qualify for.
1.Fail both the initial test and free retest
2.Incur $100 of emissions related repairs
3.Drive less than 5,000 miles/year
If you meet these qualifications then you would qualify for the low mileage waiver. Contact the DPS challenge station in your area for more information on the forms to complete.

If its tuned and you have removed any emissions equipment and it still shows 'not ready', take it back to whomever tuned it lol. Are you sure it doesn't say N/A?
The $100 in repairs can be done by you, just need the receipt from the parts. And it has to be within 30 days of the waiver, and can be before or after the failures.
They have an "expert" on modified cars (probably shouldn't have mentioned that but wanted to be honest/up front) that is off today. I am to call him tomorrow.
