Signed a contract unknowlingly.. need some advice

Default Signed a contract unknowlingly.. need some advice

I understand that this is a car forum and this is the wrong section for this. but I need some advice...

On Dec 7th, 2 friends and I went to some apartments and asked for an application. She gave us the appication and some other paperwork. We then went and checked out the place, one guy was already living in there and the place was a shitty. We didnt want to live there. The next day my friend called and said that we were no longer interested in the place(just to give them the heads up). We signed a contract to move in somewhere else...

Yesterday they called my friend and asked when we were moving in. He was confused and they told him that we We filled out all the paperwork and in it all wwas a 25 page contract(we didnt even notice). We were just going through initialling everything not even paying attention to what it was. On the first page it said "housing contract" DAMN. So they said that they will let us out of the contract for $237 each(which is a small price to pay for such a big mistake but it is still gay). My dad checked out the contract and all of the pages on top says "2007-2008". Commencement day is 1/1/07 expiration date is 7/31/07. BUT under the payment schedule it says Jan 1 2008 - july 31 2008. We pointed that out to them and they said, "thats fine. We will keep the rooms open and you guys will pay the $1953 in rent in 2008. "
We didnt pay any application fees, we didnt leave a deposit, we didnt get the gauarantor stuff turned in. Nothing.
All of us really had no idea that we signed a contract.
We told them that we called a day after we filled out the forms to tell them that we were no longer interested. So they let the guy off the hook at that called, but not me and my other friend. Even though when he called he said "WE" are no longer interested, but I guess that all of us needed to call seperately, but they failed to tell us that.
Is there anything I can do? Or am i pretty much **** out of luck? It was obviously our fault, i learned my lesson. But do the date mistakes make a difference? None of us knew that we were entering into a contract.
The lady told us today that everytime she gives a contract to someone that she clearly says "you are entering into a legal binding contract", bull ******* **** you do. she didnt tell us anything. My mind was on my final I was about to take, so unfortuanately I was not too attentive to what i was signing
would you guys pay the 237 each? or just wait to see what they try to do to me in a yr?

That sucks! I was in that same shitty *** situation. Well it turned out that when ever you get something of course read in entirely, but I got sent to the DA's office!! That is more of a mess if they send you there for their "collection". It eventually got all taken care of. I had to prove that I had enough funds to cover rent and the application fee had it been presented. Weird how that cleared it up but it did. I hope someone can offer you more help.

April, thanks for the help. Is there any chance that you can explain what happened with yours in more detail and what you did to get rid of it? I dont know much about any of this.

Screw em. I wouldn't give a cent after they screwed you with the way they presented the contract and with the conversation as stated.

Was it notarized? If not she can kiss it.... Also are your parent's paying for your rent? They have to sign somewhere as well. 237 is cheap though. I think they are getting a month's rent out of you guys.

Damn dude that sucks....well that happened to a friend of mine and they had to pay like 200 bucks each, but i would still try to get out of it...

but from what i hear some apartment managers are pretty shady!

ya rent is actually 279 which is a bad *** deal but the place was crap. 237 is 85% of a months rent. and no. im paying for my rent, but since i dont make 3 times my rent. i would need the guarantor. the "main guy" over at the apartments is a ******* douche. he knows damn well that this is fucked up. he's just trying to get some money.

Dont quote me, but dont you legally have 30 days in TX to back out of any legal agreement?

Sucks man, I doubt it has to be notorized though. I would just pay the $237 and take the lessons learned. I have never seen a place that makes you fill anything out before you look at the place though. either way though man it a sorry situation, good luck with everything.

pay the 237 and chalk it up to a lesson learned. even if you take her to court its going to cost you more than that with all the time involved.

not takin anyone to court dummy, just get a lawyer to talk business with them and they will nut up, they are assuming that they are dealing with uninformed punk kids, which puts the ball in Donahues court if the law contacts the apartment complex and spouts off about fraud and whatnot.
