Hold your empty hand next to your ear and have a conversation with someone in the vehicle. Is that much different than talking on the phone? My point is that this is not the root of the problem. It's the idiots driving. These are the same people who drive like maniacs with full attention on the road.
If you can't drive a car and talk on the phone at the same time, you should shoot yourself in the ******* brain.
As the other guy said, it's not the act of holding the phone, is the fact that some dumb ***** neolithic cranial fluid can't process the two things at the same time. And since their conversation is much more important than staying alive, they shift their entire one brain cell to talking instead of driving.
Also, you shouldn't be responsible for another ADULT putting on their seatbelt in your car. If I'm going out to lunch with a full load of GROWN MEN, I'm not going to do a seatbelt check like I'm taking my neighbors kids to soccer practice.

Holding my hand next to my head would be very different. One it's empty and i'm not jacking with it and two i'm not concentrating on being able to hear someone on the phone if i hit a bad reception area.
