Question Ebay Legality ?

Just sold a lg phone not too long ago on ebay to a little girl up in St. Louis and was wondering if I should refund her money or not

Bottom line is that it stated in the auction description 2 very clear details:

1. No refunds no returns
2. the phone's esn has not been cleared, but it can be done via sprints customer service by callin in the esn (which is a quote of what I was told by a sprint customer service rep)

I bought the phone from a guy here in dallas who apparently didn't pay his entire bill before he cancelled his account with them, I'm trying to get him to pay it to remedy the situation without a return but who knows if he'll do it or not

With those two key peices of info listed in the auction above would you guys refund this girl's money because she can't get it activated?

Well... You kind of made it sound like it could be fixed just by calling sprint...but in actuallility(sp? wtf? LOL) the bill needs to paid first. Its kind of a toss up. I wouldnt refund her anything if you hadnt thrown in that it could be cleared by simply calling sprint. And I doubt that guy will pay it off... doyou know how much he owes sprint?

Maybe she could say that she was told by a sprint customer service op that the bill didnt need to be paid or something and that shes pissed that shes hearing a diff explanation now.
just an idea?

I didn't know the dude hadn't paid his bill until the lady called and tried to activate it and thats what they told her

oh... Thats weaksauce. I'd prob refund her. And then go back to that guy and get your money back.

**** who knows... maybe shes lying and shes going to give you back her phone with a bad esn... dont refund her.

Refund once the phone is back into your posession and you can see that the esn is the same as the one you have sold her. Tell her to open a dispute with paypal if thats how the payment was made and agree to refund her underthose conditions.

have you tried to work it out with sprint and tell them the situation? you never know,they might just be glad to set the girl up as a new customer. do those guys work off commision? you could probably talk one of them into it if so...and can the esn not be cleared without clearing the first guys account?

shes likely not a "new" customer. if she was. She prob would have gotten a new/discounted/free phone from sprint when signing a new plan.
