Its one thing to test drive the car and get hit by someone, but putting the car through a fence over a curb? Thats clearly wreckless driving and i dont care what clause a shop has against paying for damages. If its your fault for being a dumbass then your paying for it.

I would definately go to an attorney and report them to the better business beauro or however you spell it. I would also have it parked right in front of the shop with papers telling the story...drive away their business! the shop could weasel out of it but with huge losses in customers. I feel bad for the owner...

The owner of Houston Performance is a "clam chowder eating yankee douchebag" from Boston. I am not surprised by his spineless handling of this incident. I still can't believe these no talent *** clowns still have a shop open. Their customer service sucks, and they only appear interested in your business when you are bringing an assload of money into the shop.

Yup. Then if Steve's (the owners name IIRC) insurance doesnt cover him, hes going to have to spend thousands on an attorney to defend him in a losing case. Or he can try to settle if he has the cash available. But either way, its going to end up costing him in both his pocket book and loss of business. Dumb move. Even dumber was trying to play hardball with guy an not accept fault.

It is the shops responsibility. Every shop or dealership has an unlimited vehicle coverage policy. It covers any vehicle that is on a test drive. If this shop doesnt have this policy then they are in deep pooh. I work in a dealership and we have this type of policy, it includes all vin's and all vehicle that are in posession of the dealership. As long as there is an open repair order then it is covered. Hope this helps, Josh
