They will catch it, when you file your 2008 return in 2009, use the line "Carried foward refund from next year" line.

The IRS knows all!

are we still speaking hypothetically, or are you prepared to confess that you've got $70 that belongs to Uncle Sam

You can't send it back until they notice it or it will never be credited to the right place, maybe they gave you a cost of living raise, in fact, if and when they do find out you need to charge them a $85 re-stocking fee

Just be happy you didn't pay back money as it is! Something came up from 2006 income tax return and now I have to pay back $1400 within 30 days!
