NEED help/advice on 1 1/2 yr old house

Default NEED help/advice on 1 1/2 yr old house

i bought my house new in march 06 , sat i noticed a crack that goes from roof line to slab in the bricks. i called the builder (cambridge) and received my first call back today from supervisor of build. he told me my waranty was up after one year WTF!?!?!?!?! how can this be ? its not a minor crack its the whole wall. WHAT DO I DO ?????

Read your contract and see what it says. I would think structural would have more then a 1 year warranty

i will have to reread my contract tonite i was sure struc. was 10 yrs. josh this was my first home purchase, so i dont even know what an 11 month walk thru is. i just dont see how they wont back up there work after a year, i know i cant sue so it looks like ill be in arbatration (spelling i know)

you were supposed to do an initial walk through where you point out everything you want fixed before you move in, then another after you move in at about 2 months and another at 11 months before your 1 year full warranty runs out. I am in the middle of a huge shitstorm with my builder right now about work orders i put in at 10 months and they still have yet to fix them.

Unfortunately, your builder is correct. 1 year warranty on defects of any kind. My home i bought was my first purchase but i knew about the warranty. Sounds like you were an uninformed buyer, and in this case, ignorance (not knowing) will not get you anything.

Best bet is to get into contact with some of the bigheads of the company and tell them that you made them (the building manager)aware of the defect at 11 months after moving in and they never came out to rectify the problem. Is this the right way to do it? NO, however, sometimes you have to stoop to their level to get things done.

i did the first two walk thru's but knew nothing about a third at 11 months. i was told i will be getting a call from head office next.

do some research and find out who the VP's and exec's are.... call them. I have used this tactic in the past and the only thing they wanted to know before they fixed my problem was how the **** i got their number

Before you get too fired up make sure it is even a structural issue. It may be purely cosmetic. How wide is the crack? Does the crack extend through the slab or is it just in the joint between bricks. Are you having trouble with doors or windows sticking or not closing properly? Not sure what the land is like near Houston but up here East of Dallas it is not uncommon to have foundation issues. If it is a structural problem get some quotes to put piers in the area that has shifted. It may not be as expensive as you think.

the crack goes thru the joints but it also goes thru some of the bricks. my home is a new construction finished jan 06, i dont want to hear about foundation problems or anything else LOL i have to laugh right now so i dont loose it i will post some pics tonite The soil here is clay

houses in houston shift as they settle, but i would hope (doubt) there is not major foundation issues

It is not uncommon to only have a 1 year warranty on a new house. There should be a 10 year structural warranty on your house that would cover this if it is not strictly cosmetic.
